HomeMy WebLinkAboutA002 - Council Action Form dated October 10, 1995 ITEM #: DATE: 10/10/95 COUNCIL ACTION FORM SUBJECT: PUBLIC HEARING TO CONSIDER AN AMENDMENT TO THE ADULT ENTERTAINMENT SECTION OF THE ZONING ORDINANCE TO INCLUDE 'JUICE BARS'. ACTION FORM SUMMARY: The City Council is initiating an amendment to the definition of Adult Entertainment in the Zoning Ordinance to include 'juice bars'. The Planning and Zoning Commission and staff recommend approval of this amendment. BACKGROUND: In 1987, the City Council approved a Zoning Ordinance amendment, which regulated the establishment and location of adult entertainment businesses in the City. The businesses included in that definition were places of commerce commonly called 'adult book stores' and commercial establishments commonly referred to as 'adult' or 'triple x' theaters or movie arcades. On September 12, 1995, the City Council voted to initiate an amendment to Section 29.83(3) of the Zoning Ordinance to include 'juice bars' in the definition of adult entertainment. Attached to this Council Action Form is the proposed ordinance change, prepared by the City Attorney. No other changes are proposed to Section 29.83. The adult entertainment business section of the Zoning Ordinance contains a 1 ,000 foot separation provision between adult entertainment businesses, as well as, between an adult entertainment business and other land uses that are deemed incompatible. These land uses are: 1 . Schools 2. Places of worship 3. Public parks 4. Public playgrounds 5. Public plazas 6. Areas zoned for residential uses. These adult entertainment businesses also are not permitted within 200 feet of the public right-of-way of any arterial street in Ames. A map is attached to this Council Action Form, showing the commercial and industrial areas where an adult entertainment business may locate and where it may not locate. + 1 The Planning and Zoning Commission reviewed this issue at their meeting of September 20, and recommended that this amendment be approved. The adult entertainment section of the Zoning Ordinance applies to new businesses, relocation of such businesses, the addition of such business activity to any other business, and any addition or expansion of an existing adult entertainment business, which causes the business to occupy 50% more space than before the addition. ALTERNATIVES: 1. The City Council can approve the addition of 'juice bars' to the definition of adult entertainment businesses in Section 29.83(3)(a) of the Municipal Code. 2. The City Council can deny approval of the addition of 'juice bars' to the definition of adult entertainment businesses in Section 29.83(3)(a) of the Municipal Code. 3. The City Council can table this request for additional information from City staff. MANAGER'S RECOMMENDED ACTION: It is the recommendation of the City Manager that the City Council adopt Alternative #1. This will approve the addition of 'juice bars' to the definition of adult entertainment in Section 29.83(3)(a) of the Municipal Code.
