COUNCIL ACTION FORM
SUBJECT: Amendment to 30.10 of the Municipal Code to Allow Vehicles to Remain
Parked on Private Property for More Than 15 Days Without Movement if Pursuant to
Court Order
BACKGROUND:
Section 30.10 limits to 15 days the amount of time a vehicle may remain parked on
private property without movement. One provision of the OWI bill passed during last
year's Iowa legislative session was the impounding or immobilization of vehicles owned
or controlled by someone convicted of a second or subsequent drunk-driving offense.
The Police Department has determined that the most cost-efficient method for the City
to comply with these court orders is to immobilize the vehicle at the owner's private
property. As the duration of this immobilization will exceed 15 days, there would be a
conflict with Section 30.10.
ALTERNATIVES:
1. Direct the City Attorney to draft appropriate changes to Section 30.10 of the Municipal
Code.
2. Take no action.
MANAGER'S RECOMMENDED ACTION:
It is the recommendation of the City Manager that the City Council adopt Alternative #1
and direct the City Attorney to draft appropriate changes to Section 30.10 of the Municipal
Code to allow a vehicle to remain parked without movement on private property when
pursuant to a court order.
