COUNCIL ACTION FORM
SUBJECT: PUBLIC HEARING TO CONSIDER A REQUEST TO APPROVE THE
REZONING OF PROPERTY LOCATED AT 202 KEN MARIL ROAD FROM A-1
(AGRICULTURAL) TO R1-10 (LOW-DENSITY RESIDENTIAL).
ACTION FORM SUMMARY: This is a rezoning request to rezone this property from A-1
to R1-10 in order to divide the property into three single-family dwelling lots.
The Planning & Zoning Commission and staff recommend approval of this rezoning
request.
BACKGROUND:
The applicant is requesting that the City rezone 1 .02 acres from A-1 (Agricultural) to
R1-10 (Low-Density Residential) at 202 Ken Maril Road.
The legal description for this property is as follows:
Lot 1 , Southdale Fifth Addition to the City of Ames
The property owner would like to split this property into three (3) lots for three
single-family homes, and a Conceptual Development Plan (CDP) has been submitted
concurrent with this request for a three lot subdivision of the site. The R1-10 zoning
designation allows lots for single-family dwellings with a minimum size of 10,000 square
feet.
This property currently contains one single-family home that has not been completed,
which is located in the eastern portion of the site. That home will be located on one of
the proposed lots, and it meets the setback requirements of the R1-10 zoning district.
ANALYSIS:
Current Land Use and Zoning Designation of Subject Property.
There is a single-family home on the property that is still under construction, and the
remainder of the site is vacant. The present zoning of the site is A-1 (Agricultural).

Land Use Policy Plan and Zoning History.
LUPP
1977, 1981 and 1988 Land Use Policy Plan Map Designations. The subject
property is designated Low-Density Residential on the 1977 and 1981 LUPP maps
and Residential: Low-Density on the 1988 LUPP map.
Goals and Policies from the Land Use Policy Plan. The following goals and policies
from the Land Use Policy Plan (LUPP) apply to this rezoning proposal:
B. RESIDENTIAL
B.1. Goal.
To provide a wide choice of housing types and locations to serve the
residential needs of the present and future populations.
B.1.1. Policy•
The Land Use Policy Plan will serve as the basis to provide for functional
new developments, conservation and preservation of existing
neighborhoods and the rehabilitation and/or redevelopment of deteriorating
areas.
B.1.2. Policy:
New housing development will be located adjacent to existing development
to better utilize existing public facilities and to ensure the orderly growth of
the community.
The proposed rezoning from A-1 to R1-10 for this property is consistent with the Land
Use Policy Plan designation of Residential: Low-Density. The intent of the property owner
is to create three single-family dwelling lots. This rezoning would result in new housing
located adjacent to existing development and existing utilities, and it would provide an
opportunity for additional single-family housing in the community.

Zoning.
This property has been zoned A-1 (Agricultural) since 1975 when this property was
annexed into the City.
Utilities. Utilities are adequate to serve the proposed development.
Water: There is an 8-inch water main along the north side of Ken Maril Road.
Sanitary Sewer: An 8-inch sanitary sewer main is located in the center of Ken
Maril Road.
Storm Sewer: There is a ditch with a storm sewer intake along South Duff
Avenue.
Electric: There is adequate capacity to serve this site.

Note: The existing home that is under construction meets the setback requirements for
the R1-10 zoning district.
Transportation. Access to the subject property will be from Ken Maril Road. This
property also abuts South Duff Avenue, however, since South Duff Avenue is an arterial
street and a State highway, no access to the subject property will be permitted from this
street. There is a Cy-Ride stop one block to the east of this site at the corner of Emerald
Drive and Ken Maril Road. There are no bicycle paths planned in this area.

Impacts on the Neighborhood. The proposed rezoning from A-1 to R1-10 would allow
the creation of two additional home sites in the area. This type of development is
consistent with the existing single-family development to the north and east of the site and
would further the goal of the LUPP to provide a wide choice of housing types and
locations to serve the residential needs of the present and future populations of the
community.
STAFF COMMENTS:
Staff believes the rezoning of this property is consistent with the LUPP designation and
the goals and policies of the plan, therefore the property should be rezoned to allow for
the subdivision of this property into three lots.
The Planning and Zoning Commission reviewed this request at their meeting of August
16, 1995 and recommended that it be approved.
ALTERNATIVES:
1 . The City Council can approve the owner's request to rezone the property at 202
Ken Maril Road from A-1 to R1-10.
2. The City Council can deny approval of the owner's request to rezone property
located at 202 Ken Maril Road from A-1 to R1-10.
3. The City Council can table this request and refer it back to City staff and/or the
applicant for additional information.
MANAGER'S RECOMMENDED ACTION:
It is the recommendation of the City Manager that the City Council adopt Alternative #1 .
This will approve the rezoning of the property at 202 Ken Maril Road from A-1 to R1-10.
This rezoning of the property will allow the developer to proceed with the replatting of this
property into three lots for single-family homes.
