AN ORDINANCE TO AMEND THE MUNICIPAL CODE OF THE CITY OF
AMES,IOWA,BY REPEALING SECTION 28.437 AND RE-ENACTING THE
SAME REVISED RELATIVE TO REFUND OF EMPLOYEE
CONTRIBUTIONS TO THE UTILITY RETIREMENT SYSTEM; REPEALING
ANY AND ALL ORDINANCES OR PARTS OF ORDINANCES IN
CONFLICT TO THE EXTENT OF SUCH CONFLICT; AND ESTABLISHING
AN EFFECTIVE DATE.
BE IT ENACTED, by the City Council for the City of Ames, Iowa, that:
Section One. The Municipal Code of the City of Ames, Iowa shall be and the same is hereby amended by
repealing Section 28.437 thereof and re-enacting that Section revised to state as follows:
"Sec. 28.437. ACCUMULATED CONTRIBUTIONS, WHEN PAYABLE.
Upon termination of employment by resignation or dismissal, an employee with less than
five full and consecutive years of creditable service shall be paid the amount of the employee's
accumulated contributions (including employee contributions "picked up" by the utility after
December 31, 1995), except that any such employee may elect not to withdraw such accumulated
contributions as were made prior to February 1, 1964.
Payment shall be made in a single cash sum as soon as practicable after receipt by the
director of finance of a written notice from the employee's administrative officer that the employee
has been separated from employment."
Section Two. All ordinances or parts of ordinances in conflict herewith are hereby repealed to the extent
of such conflict, if any.
Section Three. This ordinance shall be in full force and effect from and after its passage and publication
as required by law.
