Re: Ordinance to Amend Sec. 12.3, Qualifications for Hospital Trustees
Dear Mayor Curtis and Council Members:
In an effort not to create any restrictions with respect to the City Hospital Board of
Trustees, I concluded this spring that a person could be a candidate for trustees if
nominated under the provisions of the election laws, even if not a resident of the City.
Today the County Auditor's office has referred me to the wording in the statutes that
pertain to nomination for city offices which has been interpreted as requiring that a
candidate be a resident of the city to which the office pertains.
For that reason I recommend that the City Council adopt the attached ordinance to amend
Sec. 12.3 of the Municipal Code to delete the statement that: "A hospital trustee need not
be a resident of the City of Ames."
