AN ORDINANCE TO AMEND THE MUNICIPAL CODE OF THE CITY OF
AMES, IOWA, BY REPEALING SECTION 21.701 AND ENACTING NEW
SECTIONS 21.701 AND 21.801 FOR THE PURPOSE OF REQUIRING A
PERMIT FOR THE INSTALLATION OF IRRIGATION SYSTEMS;
REPEALING ANY AND ALL ORDINANCES OR PARTS OF ORDINANCES
IN CONFLICT TO THE EXTENT OF SUCH CONFLICT; PROVIDING A
PENALTY; AND ESTABLISHING AN EFFECTIVE DATE.
WHEREAS, it has been found that irrigation systems have been sold and installed at premises where the
size of the water service relative to the pre-existing demands on the service resulted in the water supply being
inadequate to drive the irrigation system; and,
WHEREAS, it is deemed to be in the public interest that before an irrigation system is sold and installed
for any place that the water service and existing demands for water at that place be evaluated by the plumbing
inspector to determine if there is sufficient water service at that place to meet the water demands that will be
presented by the addition of an irrigation system.
NOW, THEREFORE, BE IT ORDAINED by the Ciy Council for the City of Ames, Iowa:
Section One. The Municipal Code of the City of Ames, Iowa shall be and the same is hereby amended by
repealing Section 21.701 and enacting new Sections 21.701 and 21.801 as follows:
"ARTICLE VII
IRRIGATION SYSTEMS
Sec. 21.701. IRRIGATION SYSTEM PERMIT REQUIRED.
(1) No person shall sell, install or operate an irrigation system with respect to any
premises or place in the City of Ames unless and until the City of Ames Plumbing Inspector has
issued a permit for the irrigation system with respect to that place or premises.
(2) The said irrigation permit shall be issued only after it has been shown to the
reasonable satisfaction of the plumbing inspector that the water service to the premises is sufficient,
in view of the existing water using facilities at the place of proposed installation, for the proper
operation of the proposed irrigation system.
ARTICLE VIII
PENALTY
Sec. 21.801. PENALTY.
Any person, corporation or other legal entity who violates or resists the enforcement of
any of the provision of this chapter commits a municipal infraction punishable by a civil penalty
of thirty dollars ($30) for the initial offense, one hundred dollars ($100) for the second offense,
and two hundred dollars ($200) for each repeat offense. Each day that a municipal infraction
occurs constitutes a separate offense. Any person, corporation or other legal entity who violates
this ordinance after having previously been found guilty of violating the same ordinance provision
at the same location or at a different location shall be considered to have committed a repeat
offense. Seeking a civil penalty as authorized in this section does not preclude the city from
seeking alternative relief, including an order for abatement or injunctive relief."
Section Two. All ordinances or parts of ordinances in conflict herewith are hereby repealed to the extent of
such conflict, if any.

Section Three. Violation of this ordinance shall constitute a municipal infraction punishable as provided by
Section 1.9 of the Ames Municipal Code.
Section Four. This ordinance shall be in full force and effect from and after its passage and publication as
required by law.
