HomeMy WebLinkAbout~Master - Allowing a Partial Disability Benefit Under Utility Retirement System ORDINANCE NO. 3325 AN ORDINANCE TO AMEND THE MUNICIPAL CODE OF THE CITY OF AMES, IOWA, BY ENACTING A NEW SUBSECTION 28.431(6) FOR THE PURPOSE OF ALLOWING A PARTIAL DISABILITY BENEFIT UNDER THE UTILITY RETIREMENT SYSTEM; REPEALING ANY AND ALL ORDINANC- ES OR PARTS OF ORDINANCES IN CONFLICT TO THE EXTENT OF SUCH CONFLICT; AND ESTABLISHING AN EFFECTIVE DATE. BE IT ENACTED, by the City Council for the City of Ames, Iowa, that: Section One. The Municipal Code of the City of Ames, Iowa shall be and the same is hereby amended by enacting a new subsection 28.431(6) to read as follows: 11(6) An employee may, upon proper application to the Board, be grant- ed a partial disability benefit. If granted by the Board, the partial disability benefit shall be that percentage of the employee's total disability benefit which corresponds inversely to the percentage of a full-time work week that the disabled employee undertakes to work for the utility. The employee's application for a partial disability benefit shall state the percentage of the work week that the employee intends to work; and, the application shall have attached to it: (a) a signed, written opinion of the employee's attending physi- cian that the hours of work stated in the employee's applica- tion will not aggravate the employee's debilitating condition; (b) a written certification by the administrative officer of the employee that the reduced work schedule proposed by the employee is acceptable to the good management of the utility. A partial disability benefit granted under this subsection shall not continue for more than six months unless reauthorized by the Board for an additional period of six months or less." Section Two. All ordinances or parts of ordinances in conflict herewith are hereby repealed to the extent of such conflict, if any. Section Three.
