HomeMy WebLinkAbout~Master - Allowing Variations in the Duration and Applicable Times of Street Vendor Permit ORDINANCE NO. 3324 AN ORDINANCE TO AMEND THE MUNICIPAL CODE OF THE CITY OF AMES, IOWA,BY REPEALING SECTION 22.15 THEREOF AND RE-ENACTING SAID SECTION REVISED FOR THE PURPOSE OF ALLOWING FOR VARIATIONS IN THE DURATION AND APPLICABLE TIMES OF STREET VENDORS PERMITS; REPEALING ANY AND ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT TO THE EXTENT OF SUCH CONFLICT; PROVIDING A PENALTY; AND ESTABLISHING AN EFFECTIVE DATE. BE IT ENACTED, by the City Council for the City of Ames, Iowa, that: Section One. The Municipal Code of the City of Ames, Iowa shall be and the same is hereby amended by repealing Section 22.15 thereof and re-enacting the same as follows: "Sec. 22.15. ISSUANCE. (1) Not later than 30 days after the filing of a completed application for a vendor's license, the applicant shall be notified by the city of the decision on the issuance or denial of the license. The decision shall be made by the city manager or the manager's designee. (2) The city manager shall consider the standards set forth in state restaurant regulations, and state itinerant merchants regulations. No license shall be issued by the city unless there is proof that all required state licenses and permits have been applied for or obtained. In the event that two or more applications for the same location are received, the earliest application, if approved, shall be awarded the location if otherwise qualified and acceptable. (3) If a license is denied, the applicant shall be provided with a statement of the reasons therefore which reason shall be entered in writing on the application. The applicant shall be entitled to a hearing. (4) A license is valid for a period of one year, except that: (a) A license for street vending during a special event or celebration shall be limited to a stated duration of such event or celebration. (b) An annual license may be issued subject to a limitation that it shall not be in effect during the dates that a street vending license is issued with respect to a special event or celebration that encompasses the site of the annual license." Section Two. Violation of the provisions of this ordinance shall constitute a municipal infraction punishable as set out in Section 1.9 of the Municipal Code. Section Three. All ordinances or parts of ordinances in conflict herewith are hereby repealed to the extent of such conflict, if any. Section Four.
