AN ORDINANCE TO AMEND THE MUNICIPAL CODE OF THE CITY OF
AMES, IOWA, BY REPEALING SUBSECTIONS 29.24(3)(d) AND
29.26(2)(e) AND ENACTING NEW SUBSECTIONS 29.24(6) AND 29.26(6)
TO CHANGE ZONING REGULATIONS PERTAINING TO COMPLETION OF
SITE AND LANDSCAPING IMPROVEMENTS; REPEALING ALL ORDINANC-
ES IN CONFLICT HEREWITH; ESTABLISHING A PENALTY AND SET-
TING AN EFFECTIVE DATE.
BE IT ORDAINED, by the City Council for the City of Ames, Iowa:
Section One. The Municipal Code of the City of Ames, Iowa is hereby amend-
ed by repealing Subsections 29.24(3)(d) and 29.26(2)(e) and enacting new Subsec-
tions 29.24(6) and 29.26(6) to state as follows:
"Security for Site Improvements. In the event that the site and
landscape improvements, including the parking lot, walkways, lighting,
landscaping, and other site features, cannot be completed or installed
prior to occupancy due to weather or the time of year, the developer
shall sign an occupancy agreement, specifying when the site features
will be completed, and authorizing the City to go onto the site to
complete the work if not done by that time, and the developer shall
give security to the City in the form of a letter of credit, cash escrow
or certified check in an amount approved by the Director of Planning
and Housing, to guarantee the satisfactory performance of the site and
landscape plans."
Section Two. Violation of the provisions of this ordinance shall constitute
a municipal infraction, punishable as set out in Section 1.9, Ames Municipal Code.
Section Three. All ordinances or parts of ordinances in conflict herewith
shall be repealed to the extent of such conflict if any.
Section Four. This ordinance shall be in full force and effect from and
after its passage and publication as required by law.
