Re: Proposed Ordinance - Free Handicap Parking
Dear Mayor Curtis and Council Members:
You may recall that a proposal came before you last October requesting that vehicles
with handicapped identification devices be allowed to park for up to two hours without
charge in handicapped stalls. At that time, all those spaces had parking meters like
other metered parking. An ordinance was enacted allowing those drivers to park in
metered handicapped stalls for up to two hours without depositing money in the meters.
Eventually, the meters at all metered handicapped stalls were removed. This led to
enforcement problems, since the two hour time limit applied only at metered
handicapped spaces. None of those exist any longer. The two hour limitation for
metered handicapped spaces remains in the ordinance,however. Meter attendants have
received complaints about certain spaces in which vehicles remain for much longer than
two hours, parking for free, but those are not, technically, metered spaces, so no tickets
can be issued.
In order to encourage those using these spaces to limit their use to two hours, we are
recommending a change in the ordinance to remove the reference to metered
handicapped spaces. Instead, the ordinance would allow those who park beyond the
posted two hour limit to be ticketed. A proposed ordinance is attached.
