HomeMy WebLinkAboutA001 - Council Action Form dated May 24, 1994 ITEM #: 37b DATE: 05/24/94 COUNCIL ACTION FORM SUBJECT: Motion to Direct City Staff to Prepare Ordinance Amendments to Chapter 29, Zoning, of the Municipal Code to Adopt a New List of Permitted and Special Uses in the Existing H-M (Hospital-Medical) Zoning District. ACTION FORM SUMMARY: The Planning and Zoning Commission proposes the adoption of amendments to the Zoning Ordinance that would establish a new list of permitted and special uses in the H-M district. City staff recommend that the City Council direct staff to prepare ordinance amendments necessary to adopt the Planning and Zoning Commission recommendations. BACKGROUND: The Planning and Zoning Commission has studied the current list of permitted uses for the H-M (Hospital-Medical) zoning district. The Commission's recommendations for changes to the list of permitted uses were presented to the City Council on October 26, 1993. At this time, City staff request that the City Council decide if they wish to proceed with a new list of permitted and special uses for the H-M district. If Council decides to proceed, City staff should be directed to prepare ordinance amendments for consideration by City Council. ANALYSIS: Land Use Policy Plan. The H-M (Hospital-Medical) Policy adopted by City Council on April 14, 1992 addresses the need for permitted uses. Specifically, the H-M Policy states that implementation should include: Establishment of a list of permitted medical uses. Permitted Uses. The current list of permitted uses for the H-M zoning district is as follows: Sec. 29.21 H-M, HOSPITAL-MEDICAL DISTRICT. (1) Permitted Uses. A building or premises shall be used only for the following purposes: Apothecary shop Retail sale of medical, dental and related supplies Doctor's or dentist's office Hospital for treatment of humans Laboratories -- Medical and dental Medical clinic Nursing home and convalescent home Retirement and home for the elderly One-family dwelling Two-family dwelling Multiple-family dwelling Boarding and lodging house Private parking facilities The proposed list of permitted and special uses for the H-M zoning district is as follows: PERMITTED USES Hospitals Offices and Clinics of Medicine and Doctors of Osteopathic Medicine Medical Laboratories Pharmacies (Limited to the Sale of Prescription and Non- Prescription Drugs) Dental Surgeons Outpatient Short Stay Surgical Care Clinics (Non-Resident) Offices and Clinics of Health Practitioners Kidney Dialysis Centers Specialty Outpatient Facilities Health and Allied Services Offices and Clinics of Dentists Offices and Clinics of Optometrists Opticians 2 SPECIAL USES Other Similar Medical Retail Uses Commercial Multi-Level Parking Ramp All uses not listed as "permitted uses" or "special uses" are hereby prohibited. All prohibited uses that exist at the time of adoption of the list of permitted and special uses are classified as "nonconforming uses". Existing Land Uses. All existing land uses, except dwellings, in the H-M zoning district would be permitted uses if the proposed list of permitted and special uses is adopted. Existing dwellings in the H-M district, which would become nonconforming uses, include the following: Single-Family: 1102 Duff Avenue (Owner-Occupied) 1002 Douglas Avenue (Owner-Occupied) 1006 Douglas Avenue (Planned for Removal) (Currently Vacant) 1016 Douglas Avenue (Planned for Removal) (Currently Vacant) 117 10th Street (Currently Vacant) 118 11 th Street (Planned for Removal) (Currently Vacant) 210 11 th Street (Planned for Removal) (Currently Vacant) Special Uses. The special uses would be required to obtain special use permits from the Zoning Board of Adjustment after recommendations by the Planning and Zoning Commission. General standards to be used as a basis for determinations must be developed and included in the zoning ordinance provisions. Criteria. The Planning and Zoning Commission used the following criteria in selecting permitted and special uses in the H-M district: 1. The permitted use needs the hospital facilities to function. 2. The hospital needs the permitted use. 3 3. The delivery of health care services to the patient is more "efficient" (in terms of sharing equipment and staff resources) if the land use is located near the hospital. 4. The delivery of health care services is more convenient for the patient. Planning and Zoning Commission Recommendation. The Planning and Zoning Commission recommended ordinance amendments to Chapter 29, Zoning, of the Municipal Code to adopt the following list of permitted and special uses in the H-M (Hospital-Medical) zoning district. PERMITTED USES Hospitals Offices and Clinics of Medicine and Doctors of Osteopathic Medicine Medical Laboratories Pharmacies (Limited to the Sale of Prescription and Non-Prescription Drugs) Dental Surgeons Outpatient Short Stay Surgical Care Clinics (Non-Resident) Offices and Clinics of Health Practitioners Kidney Dialysis Centers Specialty Outpatient Facilities Health and Allied Services Offices and Clinics of Dentists Offices and Clinics of Optometrists Opticians SPECIAL USES Other Similar Medical Retail Uses Commercial Multi-level Parking Ramp All uses not listed as "permitted uses" or "special uses" are hereby prohibited. All prohibited uses that exist at the time of adoption of the list of permitted and special uses are classified as "nonconforming uses". ALTERNATIVES: 1. The City Council can direct City staff to prepare ordinance amendments to Chapter 29, Zoning, of the Municipal Code to adopt a new list of permitted and special uses in the H-M (Hospital-Medical) zoning district, as recommended by the Planning and Zoning Commission. 4 2. The City Council can choose not to take action on the Planning and Zoning Commission recommendations to adopt a new list of permitted and special uses in the H-M (Hospital-Medical) zoning district. 3. The City Council can modify the Planning and Zoning Commission recommendation and direct City staff to prepare ordinance amendments to adopt a new list of permitted and special uses in the H-M (Hospital-Medical) zoning district. 4. The City Council can refer this item back to City staff and/or the Planning and Zoning Commission. MANAGER'S RECOMMENDED ACTION: It is the recommendation of the City Manager that the City Council adopt Alternative #1. This action will direct City staff to prepare ordinance amendments to Chapter 29, Zoning, of the Municipal Code to adopt a new list of permitted and special uses in the H-M (Hospital-Medical) zoning district.
