SUBJECT: Hazardous Materials Cleanup and Recovery Ordinance
BACKGROUND:
The proposed ordinance establishes a requirement that persons responsible
for storing, handling, and transporting hazardous materials shall at their
own expense cleanup any spills of those materials. The ordinance also
provides a method for the city to cleanup spills if the responsible party
fails to do so, and to recover the cost for the city.
ALTERNATIVES:
1. Approve the Hazardous Materials Cleanup and Recovery Ordinance.
Thus providing a method for the city to cleanup spills and recover
the costs if the responsible party fails to do so.
2. Deny the Hazardous Materials Cleanup and Recovery Ordinance.
MANAGER'S RECOMMENDED ACTION:
It is recommended by the City Manager that the City Council adopt alter-
native number 1 above, thereby approving the Hazardous Materials Cleanup
and Recovery Ordinance.
