HomeMy WebLinkAbout~Master - Establishing Storm Water Drainage System District and Rates ORDINANCE NO. 3265 AN ORDINANCE TO AMEND THE MUNICIPAL CODE OF THE CITY OF AMES, IOWA, BY REPEALING SECTION 28.801 THEREOF AND ENACT- ING NEW SECTIONS 28.801 THROUGH 28.803 TO DECLARE ALL OF THE CITY OF AMES, IOWA AS A STORM WATER DRAINAGE SYSTEM DIS- TRICT FOR THE PURPOSE OF ESTABLISHING AND PROVIDING FOR THE COLLECTION OF RATES FOR A STORM WATER DRAINAGE SYS- TEM PURSUANT TO SECTION 384.84(1) CODE OF IOWA; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; ESTABLISHING A PENAL- TY AND SETTING AN EFFECTIVE DATE. BE IT ORDAINED, by the City Council for the City of Ames, Iowa: Section One. The Municipal Code of the City of Ames, Iowa is hereby amend- ed by repealing Section 28.801 and enacting new Sections 28.801 through 28.803 as follows: "VIII STORM WATER DRAINAGE SYSTEM Sec. 28.801. Storm Water Drainage System District. It is found and determined to be necessary and conducive to the protection of the public health, safety, welfare and convenience that all of the City of Ames, Iowa, shall be and is hereby declared to be a storm water system district within the meaning and intent of, and for the purpose authorized by, Section 384.84(1) Code of Iowa; that is, to established and collect rates for a storm water drainage system. Sec. 28.802. Rates Established. With respect to each city water utility service, and alternatively, for each city electric utility service where there is no city water service, a monthly rate of one dollar shall be charged, paid and collected as a rate for a storm water drainage system, from July 1, 1994 until July 1, 1997. Sec. 28.803. Use of Fund. The money paid and collected pursuant to Sec. 28.802 shall be held by the city in a special fund to be expended only for the purpose of constructing, operating, repairing and maintaining all kinds of conduits, drains, storm water detention devices, flow impediments, ponds, ditches, sloughs, streams, filter strips, rip-raps, erosion control devices and any and all other things useful to the proper con- trol, management, collection, drainage and disposition of storm water in the City of Ames." Section Two. Violation of the provisions of this ordinance shall constitute a municipal infraction, punishable as set out in Section 1.9, Ames Municipal Code. a Section Three. All ordinances or parts of ordinances in conflict herewith shall be repealed to the extent of such conflict if any. Section Four. This ordinance shall be in full force and effect from and after the first day of July, 1994, following its passage and publication as re- quired by law, until the first day of July, 1997.
