Motion to Initiate the Rezoning of Approximately 1.54 Acres of Land at 5212 Lincoln
Way, which is South of Lincoln Way and West of College Creek Fourth Addition, frorn
A-1 (Agricultural) to R1-6 (Low Density Residential).
Action Form Summary: This is a request to initiate rezoning of 1.54 acres
of land from A-1 (Agricultural) to R1-6 (Low-Density Residential) through a
City Council initiated rezoning.
The Planning and zoning Commission and the staff recommend that this
rezoning be approved.
BACKGROUND:
The Planning and Zoning Commission, at their meeting of January 5, 1994,
recommended that the City Council initiate the rezoning of a 1.54 acre parcel, located
south of Lincoln Way and west of the College Creek Fourth Addition. This property,
which is addressed as 5212 Lincoln Way, contains a two family dwelling and the
former "Pines" antique shop. The Planning and Zoning Commission made the
recommendation to initiate rezoning of this property as part of their recommendation
to approve the rezoning of the proposed Bentwood Subdivision property to R1-6 (Love
Density Residential). If rezoning of this property is not initiated, it would remain an
island of land, zoned A-1 (Agricultural) in the city, which abuts R1-6 zoning on the
east, south, and the west. The land to the north remains in the County and is zoned
A-1 under County zoning.

Character of Surrounding Area. The subject property abuts the College Creek
Subdivision, a low-density single-family development, on the east. Generally the
abutting area on the south and north is in agricultural use. The area to the west is in
agricultural use and also contains a former driving range.
Land Use Policy Plan (LUPP) and Zoning History.
LUPP
1981 and 1988 Land Use Policy Plan Map Designation.
The subject property was designated as RL, which is suitable for low-
density residential use on the two Land Use Policy Plan Maps. The RL
designation permits one (1) to nine (9) dwelling units per acre.
Goals and Policies from the Land Use Policy Plan. The following goals and
policies from the current Land Use Policy Plan apply to this rezoning proposal.
B. RESIDENTIAL
B.1. GOAL:
To provide a wide choice of housing types and locations to
sere the residential needs of the present and future
populations.
B.1.1. Policy:
The Land Use Policy Plan will serve as the basis to provide for functional
new developments, conservation and preservation of existing
neighborhoods and the rehabilitation and/or redevelopment of deteriorating
areas.
B.1.2. Policy:
New housing development will be located adjacent to existing development
to better utilize existing public facilities and to ensure the orderly growth of
the community.
The proposed rezoning from A-1 (Agricultural) zoning to 191-6 (Low-Density
Residential) would serve to further the goals and policies of the Land Use Policy Plan
because the future development of this property should be compatible with low-
density, single-family development. This parcel is located adjacent to an existing
single-family subdivision, College Creek, and a proposed new single-family
development, Bentwood Subdivision.

Zoning History.
1980
In 1980 the site was annexed and rezoned from county zoning A-1
(Agricultural) to city A-1 zoning. The original site contained over six (6)
acres and included a two-family dwelling and an antique shop. This
rezoning petition includes only a 1.5 acre parcel in the northeast corner of
the original parcel, which includes the two-family dwelling and the antique
shop. The remainder of the six acre parcel is part of the Bentwood
Subdivision rezoning.
Initiated Rezoning. This rezoning is consistent with the LUPP map designation of
RL, Residential: Low-Density, and the subject property abuts existing R1-6 zoning on
the east and proposed R1-6 zoning on the south and east. The rezoning of this
property will result in the elimination of an A-1 spot zone, surrounded by R1-6 zoning
on three sides. The current use of the property for a two family dwelling and an
antique shop is nonconforming in the A-1 zoning district, and it will remain
nonconforming in the R1-6 zoning district.
Utilities. The utilities in the area can be extended to serve future development in the
area.
Water Distribution:
Existing.
-- 12-inch water main along Lincoln Way, east of
Thackery Avenue.
-- 6-inch water main in Schubert Street. This property
is served from the water main in Schubert Street.
An easement will be needed through Bentwood
Subdivision for that service line.
Proposed.
-- A 12-inch water main will be extended in front of this
property along Lincoln Way from Thackery Avenue to
the west boundary Bentwood Subdivision. Any
redevelopment of this property would be served by
the 12-inch main along Lincoln Way.
Sanitary Sewer:
Existing.
-- This property is served by a septic system.

Proposed.
-- An 8-inch sanitary sewer main may be extended to
serve this property in a public utility easement from
Schubert Street in Bentwood Subdivision. This
easement is being planned as part of the CDP
approval for Bentwood Subdivision.
Storm Water Management:
Existing.
-- None.
Proposed.
-- None at this time.
Electric:
There is adequate capacity and provision made for electric
service to meet the needs of a low-density residential
development on this site.

Transportation: Access to the subject property currently is from a driveway on
Lincoln Way, which is an arterial street. Additional driveway access to Lincoln Way
will not be allowed in the future. A bicycle path will be constructed along the south
side of Lincoln Way from Thackery Avenue adjacent to the property as part of the
subdivision development process for Bentwood Subdivision. It is anticipated that Cy-
Ride will be extended west for Bentwood Subdivision and will serve this site.
Impacts on the Neighborhood. The proposed rezoning is consistent with the zoning
of the residentil development to the east, which is single-family residential and the
proposed single-family development to the west.
STAFF COMMENTS:
Staff believes the proposed rezoning is consistent with the Land Use Policy Plan
designation of Residential: Low-Density, and the surrounding, existing, and proposed
zoning in the area. The rezoning of this property should result in a coordinated
redevelopment of this site in the future.
ALTERNATIVES:
1. The City Council can initiate the rezoning of 5212 Lincoln Way from A-1
(Agricultural) to R1-6 (Low-Density Residential), as recommended by the
Planning and Zoning Commission.
2. The City Council can decide not to initiate the rezoning of 5212 Lincoln Way
from A-1 (Agricultural) to 191-6 (Low-Density Residential).
3. The City Council can table the request to initiate the rezoning of the 5212
Lincoln Way for additional information from City staff or the property owner.
MANAGER'S RECOMMENDED ACTION:
It is the recommendation of the City Manager that the City Council adopt Alternativo
#1. This action will initiate the rezoning of 1.54 acres from R1-6 to A-1, as
recommended by the Planning and Zoning Commission.
