HomeMy WebLinkAboutA001 - Council Action Form dated January 25, 1994 ITEM #: 374� DATE: 01/25/94 COUNCIL ACTION FORM SUBJECT: Passage of an Ordinance for the Rezoning of Land Generally Located South of West Lincoln Way and West of the College Creek Subdivision from County Zoning and A-1 (Agricultural) in the City to R1-6 (Low-Density Residential). Action Form Summary: This is a request to rezone 76.32 acres of land from A-1 and C-2 in Story County and A-1 in the City to R1-6 in order to develop a single-family residential subdivision. The Planning and Zoning Commission and the staff recommend approval of this request for rezoning to R1-6. BACKGROUND: This petition for rezoning includes 76.32 acres of land located along West Lincoln Way. This land includes the former Rogers Driving Range, a portion of the Pines Antique Shop property and some agricultural land to the south of the antique shop and driving range. This site with the exception of the Pine Antique Shop property is under consideration for annexation concurrent with this application for rezoning. The Pines Antique Shop property is currently in the city limits and is zoned agricultural. The developers propose to develop a 229 lot subdivision on this property for single-family detached homes, including 48 homes to be developed under Phase 3 of the City's Affordable Housing program. A conceptual development plan for this subdivision will be ready for review shortly. ANALYSIS: Current Land Use and Zoning Designation of Subject Property. The subject property abuts the College Creek Subdivision, a low-density single-family development, on the east, as well as, the Hillside Subdivision, which is currently under development, and an existing commercial/residential site that includes the Pines Antique Shop and a 3-unit multiple- family dwelling. Generally the abutting area on the south, west, and north is in agricultural use. Two mobile home parks are also located to the west and northwest of the development site. Land Use Policy Plan (LUPP) and Zoning History. LUPP 1977, 1981, and 1988 Land Use Policy Plan Map Designation. The subject property was designated as suitable for agricultural use on the three Land Use Policy Plan maps. On August 24, 1993 the City Council amended the LUPP map to designate this site as suitable for Residential: Low-Density, which permits one to nine dwelling units per acre. Goals and Policies from the Land Use Policy Plan. The following goals and policies from the current Land Use Policy Plan apply to this rezoning proposal. B. RESIDENTIAL B.1. GOAL: To provide a wide choice of housing types and locations to serve the residential needs of the present and future populations. B.1.1. Policy: The Land Use Policy Plan will serve as the basis to provide for functional new developments, conservation and preservation of existing neighborhoods and the rehabilitation and/or redevelopment of deteriorating areas. B.1.2. Policy New housing evaluation development will be located adjacent to existing development to better utilize existing public facilities and to ensure the orderly growth of the community. 2 The proposed rezoning from A-1 (Agricultural) and C-2 (Highway Commercial) in the County and A-1 (Agricultural) City zoning to 191-6 (Low-Density Residential) would serve to further the goals and policies of the Land Use Policy Plan because the proposed development of this property is a low-density, single-family subdivision, which will provide a choice of single-family homes at various price ranges to serve the present and future needs of the community. This new development is located adjacent to an existing single-family Subdivision and the streets within the new development area will coordinate with the existing and proposed street design for the College Creek and Hillside Subdivisions. Zoning History. 1980 In 1980 the northeast corner of the site was annexed and rezoned from county zoning to A-1 in the city. That site contained over six (6) acres of individual and a multiple-family dwelling and an antique shop. This rezoning petition does not include a 1.5 acre parcel that includes the multiple-family dwelling and the antique shop, however, it includes the remainder of the six (6) acre parcel that was annexed in 1980. Requested Rezoning. The owner is requesting a rezoning from County A-1 (Agricultural), county C-2 (Highway Commercial) and A-1 (Agricultural) zoning in the city to R1-6 (Low-Density Residential) in order to develop a 229 lot low-density, single- family Subdivision. This rezoning is consistent with the LUPP map designation which was amended in August of 1993, to Residential: Low-Density and the subject property abuts 191-6 zoning on the east for a distance of nearly 2000 feet. Utilities. The utilities in the area can be extended to serve future development in the area. Water Distribution: Existing. -- 14-inch water main along Lincoln Way. -- 12-inch water main is proposed for Clemens Parkway, which is a street in the Hillside Subdivision to the east which will connect with this site. Note: The 12-inch water main in Lincoln Way will serve the northern portion of the site, while the 12-inch water main from Clemens Parkway will be extended west to serve the southern portion of the site. 3 Proposed. -- A water main system within the development will be designed as part of the subdivision of this property. The water mains will be looped through the site. Sanitary Sewer: Existing. -- 12-inch main has been stubbed to the east boundary of the subject property adjacent to College Creek in anticipation of future development into this area. Note: As stated above there is an existing constraint in capacity of the College Creek sanitary service system which will require upgrading in the Campustown area. This upgrade which is a City responsibility has been placed in the Capital Improvement Program for fiscal year 1995-96. Storm Water Management: Existing. -- College Creek extends into the site. Proposed. -- A storm water management plan will be designed as part of the subdivision process for the site, which will discharge into College Creek. Electric: There is adequate capacity and provision made for electric service to meet the needs of a low-density residential development in this area. Comparison of Bulk Regulations. Transportation: Access to the subject property currently is from Lincoln Way, which is an arterial street. As this property develops into a subdivision, access will also be available from Schubert Street and Thackery Avenue located to the east in College Creek Subdivision and from Clemens Boulevard, which will be developed in the future Hillside Subdivision. A bicycle path will be constructed along the south side of Lincoln Way adjacent to the property as part of the Subdivision development process. It is anticipated that Cy-Ride will be extended to serve this development. It currently serves the college Creek Subdivision to the east. Affordable Housing. The developers of this site have submitted a proposalto the City to construct 48 homes as part of Phase 3 of the City's Affordable Housing Program. The proposal includes 24 homes to be constructed for $60,000 and 24 homes that will be available at approximately $72,000 for low and moderate income, first-time home buyers. The City will utilize a Special Purpose Grant from the federal government to offset the costs of infrastructure for this affordable housing project. Impacts on the Neighborhood. The proposed rezoning is consistent with the zoning of the residential development to the east, which is also single-family residential. It is anticipated that the development of the subject property will be compatible with the development to the east with similar size lots and a coordinated traffic pattern. STAFF COMMENTS: Staff believes the proposed rezoning is consistent with the Land Use Policy Plan designation of Residential: Low-Density, and the rezoning of this property should result in a coordinated development of this area, which will significantly increase the number of available single-family dwelling units. This project will also help to address the need for affordable housing for low and moderate income home buyers. 5 The Planning and Zoning Commission reviewed this request at their meeting of January 5, 1994 and recommended that this rezoning request be approved. Additionally, the Planning and Zoning Commission also recommend that the City Council initiate the rezoning of the small, remaining portion of land that includes the 3- unit apartment structure and "The Pines" antique shop. This rezoning is recommended to be from A-1 (Agricultural) to R1-6 (Low-Density Residential). ALTERNATIVES: 1. The City Council can approve of this request to rezone the subject property from A-1 and C-2 (County Zoning) and A-1 City Zoning to R1-6 as recommended by the Planning and Zoning Commission. 2. The City Council can deny approval of this request to rezone the subject property from A-1 and C-2 (County Zoning) and A-1 (City Zoning) to R1-6. 3. The City Council can table the request to rezone the subject property from A-1 and C-2 (County Zoning) and A-1 (City Zoning) to R1-6 for additional information from the developer or City staff. Action Must be taken by the Commission by their meeting of March 16, 1994. MANAGER'S RECOMMENDED ACTION: It is the recommendation of the City Manager that the City Council adopt Alternative #1. This will approve of the rezoning from A-1 and C-2 (County Zoning) and A-1 (City Zoning) to R1-6 for the subject parcel. This rezoning is consistent with the Land Use Policy Plan designation for the area, and it will enable the developers to proceed with their Subdivision proposal to develop a low-density, single-family residential Subdivision.
