Curtis, Mayor, �A and Members of the City Council ; of the City of Ames, Iowa Re: Technical Amendment to Parking Penalty Provisions Dear Mayor Curtis and Council Members: You may recall that you recently enacted an amendment to the Handicapped Parking provisions of Chapter 18 of the Municipal Code to allow drivers of vehicles with handicapped parking permits to park without charge at metered handicapped spaces for up to two hours. As written, this ordinance had three separate subsections, but the penalty provision, specifying a $50 fine, had no reference to which subsection it applied. To be consistent with state law, the $50 fine should have applied only to §18. 18(1) - parking in a handicapped space without a permit, and a $5 fine would apply to parking free for too long in a space. To provide for these different fine amounts, a technical amendment is requested to the general penalty provision of Chapter 18 which would specify that §18. 18(1) carries a $50 fine, and other violations under this section are $5 fines. Attached please find the proposed amendment which will codify this clarifica- tion. It is respectfully requested that you consider adoption of this amendment. Sincerely, JudyK.
