HomeMy WebLinkAboutA002 - Council Action Form dated October 26, 1993 E ITEM #: gx?✓ DATE: 10/26/93 COUNCIL ACTION FORM SUBJECT: Resolution Approving an Ordinance to Amend the Municipal Code of the City of Ames, Iowa, by Repealing Sections 26.77 and Re-enacting Sections 26.77 and Enacting a New Section 26.78 for the Purpose of Prohibiting Stopping on the Traveled Portion of a Roadway; Repealing all Ordinances in Conflict Herewith; Establishing a Penalty and Setting an Effective Date. ACTION FORM SUMMARY: This is a request to amend the Municipal Code for the purpose of prohibiting stopping on the traveled portion of a roadway and establishing a penalty of $50.00 for the infraction. This is in response to a Campustown request. Staff recommends approval. BACKGROUND: In preparation for the Campustown area improvement project, City Council, in accordance with the Campustown Betterment Association (CBA) , has initiated the establishment of parallel parking on both sides of the 100 block of Welch Avenue and established loading zones for the delivery trucks in Campustown on the first week of October. The system has been in place for two weeks with much success, but also with a few problems. The two main problems as expressed by the Campustown Betterment Association (see attached letter) are the unauthorized vehicles parking in the loading zones and the double parking of some delivery vehicles on Welch Avenue. City staff has met with the CBA to discuss these problems and has the support of the CBA for quick action to remedy the situation. The City Attorney has been asked to draw up an ordinance to address this need. Also, a fine structure being recommended by City staff is a ticket for $50.00 for a violation in the 100 block of Welch Avenue. The fine was set at this amount based on the past experience of increasing the unauthorized parking in handicapped parking places and the quick compliance to this increase. The fine and no stopping on the traveled portion of the roadway regulation will be posted along the 100 block of Welch Avenue. The fine will be a moving violation cited to the driver of the unattended vehicle. City staff is recommending a scheduled fine of $50.00. The ordinance allows up to $100.00 and 30 days in jail. 2 The City Council is being asked to adopt an ordinance to enable enforcement of prohibiting stopping on the traveled portion of a roadway and setting a fine structure at $50.00 per violation ordinance in the 100 block of Welch Avenue. ALTERNATIVES: 1. The City Council can approve the resolution establishing prohibiting stopping on the traveled portion of a roadway and setting a fine structure at $50.00 per violation for the City of Ames and establishment of a $50 fine structure for the 100 block of Welch Avenue. 2. The City Council can deny approval of the resolution establishing prohibiting stopping on the traveled portion of a roadway and setting a fine structure at $50.00 per violation for the City of Ames and establishment of a $50 fine structure for the 100 block of Welch Avenue. 3. The City Council can direct staff to further review the ordinance. MANAGER'S RECOMMENDED ACTION: It is the recommendation of the City Manager that the City Council adopt Alternative #1. This will ease the transition for the Campustown merchants and their suppliers, and the citizens of Ames in the transformation of Campustown. A note to City Council -- the enforcement of this new ordinance will be eased into by City staff. A warning to move the vehicle immediately without a ticket being issued will be given initially. If repeated offenses are observed, tickets will be issued. It is City staff's utmost concern to work with all parties involved in creating a workable solution to this problem in Campustown.
