HomeMy WebLinkAbout~Master - Providing Rehabilitation Program, Persons on Disability under Utility Retirement ORDINANCE NO. 3213 AN ORDINANCE TO AMEND THE MUNICIPAL CODE OF THE CITY OF AMES, IOWA, BY ENACTING A NEW SUBSECTION 28.74(5) FOR THE PURPOSE OF PROVIDING A PROGRAM FOR REHABILITATION FOR PERSONS ON DISABILITY UNDER THE UTILITY RETIREMENT SYSTEM; REPEALING ALL ORDINANC- ES IN CONFLICT HEREWITH AND SETTING AN EFFECTIVE DATE. BE IT ORDAINED, by the City Council for the City of Ames, Iowa: Section One. The Municipal Code of the City of Ames, Iowa is hereby amended by enacting a new Subsection 28.74(5) as follows: 11(5) At such time as when disability benefits are approved for an employee by the board: (a) The board shall arrange for a disability assessment study to be made, except when it appears the dis- ability may be temporary or terminal, with respect to that employee by a firm or person established in the business of performing such assessments, for the purpose of assessing the potential for cost-effec- tive rehabilitation of the employee for future employment. The disabled employee shall cooperate in that assessment as a condition to continued receipt of disability benefits. (b) If the report of assessment is deemed by the board to indicate a potential for vocational rehabilita- tion that would enable the employee to become so employed as to receive an earned income that would result in an offset to disability benefit payments under subsection 4 above in an amount equal to the time cost of money expended from the utility retire- ment fund to pay for the rehabilitation program services for the employee, the trustees may author- ize the employee to participate in such a vocational rehabilitation program recognized by the state board of vocational education. (c) Participation in the vocational rehabilitation program shall be voluntary for the employee." Section Two. All ordinances or parts of ordinances in conflict herewith are hereby repealed to the extent of such conflict, if any. Section Three.
