HomeMy WebLinkAbout~Master - Amending Zoning Regulations Pertaining to Mobile Home Parks l ORDINANCE NO. 3206 AN ORDINANCE TO AMEND THE MUNICIPAL CODE OF THE CITY OF AMES, IOWA, BY REPEALING SUBSECTIONS 29.20(5)(a) , 29.20(6), 29.20(18)(e), 29.20(18)(f), 29.20(18)(h) AND RE-ENACTING SAID SUBSECTIONS, EX- CEPT 29.20(6), WITH CHANGES; ENACTING A NEW SUBSEC- TION 29.20(18)(i); FOR THE PURPOSE OF REVISING ZONING REGULATIONS PERTAINING TO GARAGES, AWNINGS AND DECKS IN THE R-5 (MOBILE HOME) DISTRICT AND ELIMI- NATING REQUIREMENTS FOR STORM SHELTERS; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; ESTABLISHING A PENALTY AND SETTING AN EFFECTIVE DATE. BE IT ORDAINED, by the City Council for the City of Ames, Iowa: Section One. The Municipal Code of the City of Ames, Iowa is hereby amended by repealing subsections 29.20(5)(a), 29.20(6), 29.20(18)(e), 29.20(18)(f), 29.20(18)(h) and re-enacting said subsec- tions, except 29.20(6) pertaining to storm shelters, with changes and enacting a new subsection 29.20(18)(i) as follows: "(5) (a) Certain accessory buildings or structures which are complementary to the mobile home such as carports, cabanas, garages, patio awnings, porches, and storage buildings. Accessory structures shall not obstruct required openings for light and ventilation and shall not prevent inspection of mobile home equipment and ventilation. (18) (e) No part of any mobile home, or room addition shall be located less than thirty (30) feet from the exterior boundary of the mobile home park, except for awnings and raised open decks. Awnings and open decks may extend up to ten (10) feet into the required thirty (30) foot setback area. (f) A minimum setback between mobile homes or perma- nent buildings within the mobile home park shall not be less than twenty (20) feet, except in the case of a detached garage. If structural additions to a mobile home are anticipated, design distances be- tween mobile homes must be computed in anticipa- tion that the addition is already a part of the mobile home. A detached garage may be permitted in the twenty (20) foot setback area, provided a minimum of six (6) feet is maintained between struc- tures. . Ak (h) Minimum Setback and Size Requirements for De- tached Garages and Accessory Buildings. (i) The minimum required setback for detached garages and buildings that are accessory struc- tures shall be twenty (20) feet from the street, twenty (20) feet from the rear of the structure to the next structure, and six (6) feet between structures on the side. (ii) The maximum gross floor area for a detached garage or other accessory building shall be six hundred (600) square feet. (i) Written Agreement Addressing Ownership of De- tached Garages and Other Accessory Buildings. (i) Prior to the issuance of permits for the con- struction of a detached garage and other acces- sory buildings, a signed agreement between the owner of the mobile home park property and the owner of the mobile home that estab- lishes ownership of the proposed building, shall be filed with the City Building Offi- cial." Section Two. Violation of the provisions of this ordinance shall constitute a municipal infraction, punishable as set out in Section 1.9, Ames Municipal Code. Section Three. All ordinances or parts of ordinances in conflict herewith shall be repealed to the extent of such conflict if any. Section Four.
