HomeMy WebLinkAboutA001 - Council action Form dated July 14, 1992 ITEM #: DATE: e1419 COUNCIL ACTION FORM SUBJECT: Motion to Set July 28, 1992 as the Date of Public Hearing to Consider a Request to Rezone Property at 2412 Timberland Road from R-1 (County) to R1-10 (Low-density Residential) ACTION FORM SUMMARY: This is a request to rezone .42 acre of land at 2412 Timberland Road from R-1 (County) to R1-10 (Low-density Residential). Concurrently the applicants are requesting annexation of this property. The Planning and Zoning Commission and staff recommend approval of this rezoning, provided the annexation is approved and the stipulation of the annexation approval is met. BACKGROUND: The applicants are requesting approval of a rezoning of a single parcel of land from R-1 (County Zoning) to R1-10 (Low-density Residential). Concurrent with this request the applicants are requesting annexation of this property in order to receive City water and sanitary sewer services. This parcel contains .42 acre, and a single family dwelling is located on the site. The legal description is attached to this document. This property can be served by City utilities, which are adjacent to this property in Timberland Road. ANALYSIS: Existing Land Use/Zoning. The Land Use Policy Plan (LUPP) Map designates this property as suitable for Low-density Residential development (1-9 units per acre). The proposed density of this parcel is consistent with the LUPP Map designation Zoning. The current zoning of this property is R-1 (Residential-Story County). The applicants are proposing a rezoning to R1-10 (Low-density Residential). It should be noted that the surrounding land which is within the corporate limits is zoned S-R (Suburban Residential). A comparison of the bulk regulations between the S-R and R1-10 zoning designations are listed below: Comparison of Bulk Regulations. Side Yard: 20 ft. 6 ft. - one story 8 ft. - two stories 10 ft. - three stories Rear Yard: 25 ft. 25 ft. Max. Height: 3 stories or 40 ft. 3 stories or 40 ft. Since this parcel contains .42 acre, which is less than 20,000 square feet, the appropriate zoning would be R1-10 since it has a minimum lot size of 10,000 square feet. Although abutting property is zoned S-R, there are other lots in the Timberland Road area that contain less than 20,000 square feet, and they are zoned 111-10. In the future the City should take a look at some of the other parcels in the area that may be non-conforming because of parcel size and determine an appropriate zoning designation in a more comprehensive manner. Utilities. The public utilities in the area include the following: Water: 6-inch water main in Timberland Road. Sanitary Sewer: 8-inch sanitary sewer main in Timberland Road. Storm Sewer: None Electric: Service is provided by Iowa Electric Light and Power Company. 3 As noted in the annexation report, there is an assessment against this property for water and sanitary sewer, which were put in a number of years ago. That assessment will have to be paid with interest before the annexation of this property will be accepted by the City. The Planning and Zoning Commission reviewed this request at their meeting of June 17, 1992 and recommended that it be approved. ALTERNATIVES: 1. The City Council can approve of the request to rezone the property at 2412 Timberland Road from R-1 (Residential-Story County) to R1-10 (Low-density Residential) and set July 28, 1992 as the date of public hearing on this request. 2. The City Council can approve of a rezoning of this property from R-1 (Residential-Story County) to a zoning designation other than R1-10 (Low-density Residential) for property at 2412 Timberland Road and set July 28, 1992 as the date of public hearing on this request. 3. The City Council can deny approval of the request to rezone property from R-1 (Residential-Story County) to R1-10 (Low-density Residential) and set July 28, 1992 as the date of public hearing on this request. 4. The City Council can refer the rezoning request back to City staff or the applicants for additional information. MANAGER'S RECOMMENDED ACTION: It is the recommendation of the City Manager that the City Council adopt Alternative #1. This will approve of the request to rezone 2412 Timberland Road from R-1 (County Zoning) to R1-10. The R1-10 zoning is consistent with the parcel size and the proposed use of the property.
