HomeMy WebLinkAboutA001 - Council Action Form dated May 26, 1992 c � ITEM #: DATE: 0 26/92 COUNCIL ACTION FORM SUBJECT: Motion to Set June 9, 1992 as the date of Public Hearing to Consider a Technical Amendment to the Zoning Ordinance to Allow Public Schools as a Permitted Use in the A-1, 111-10, 111-6, R-2, 112-7, R-3 and R-4 Zoning Districts. ACTION FORM SUMMARY: These amendments to the Zoning Ordinance are being requested so that public schools can be considered permitted uses in the "A-1" and "R" zoning districts in the city. The Planning and Zoning Commission and staff recommend approval of these amendments since City staff will be reviewing site plans for improve- ments on school property, and public schools should be clearly permitted by the Municipal Code. BACKGROUND: Currently, public schools are not included as a permitted use in any zoning district in the city. They probably were not included because previously the City did not exercise zoning control or apply other City codes to public school property. However, now the City and the School District are working together to comply with City regulations. As a result of this cooperation, staff is suggesting that the public schools be included as a permitted use in the A-1 zoning district, as well as, in all of the "R" residential districts. This inclusion can easily be accomplished by adding "public schools" to the permitted use list for the A-1, 111-10, 111-6, R-2, 112-7, R-3 and R-4 zoning districts. ANALYSIS: Staff suggests the following addition to the following sections of the zoning ordinance: Section 29.12, A-1 Agriculture. (1) Permitted Uses. A building or premises shall be used only for the following purposes: Agricultural pursuits and farm-related activities Plant nurseries including greenhouses Stables Cemeteries Golf courses, except miniature golf courses and driving ranges operated for commercial purposes 2 Country clubs Places of worship Private schools having curriculum similar to that offered by public schools Public schools Single-family dwellings Supervised group homes Section 29.14, R1-10 Low-Density Residential. (1) Permitted Uses. A building or premises shall be used only for the following purposes: Single-family dwellings Places of worship Cemeteries Golf course, except miniature golf courses and driving ranges operated for commercial purposes Country club Private schools having curriculum to that offered by public schools Public schools Supervised group homes Section 29.15, 111-6 Low-Density Residential. (1) Permitted Uses. A building or premises shall be used on the following purposes: Single-family dwellings Two-family dwellings if constructed or under construction prior to November 1, 1983, and if originally designed and built pursuant to a zoning and building permit as a two-family dwelling, and not a single-family dwelling converted to a two-family dwelling as evidenced by the plans on file with the Chief Building Official. Places of worship Cemetery Golf course, except miniature golf courses and driving range operated for commercial purposes Country club Private schools having curriculum similar to that offered by public schools Public schools Supervised group homes Section 29.16, R-2, Low-Density Residential District. (1) Permitted Uses. A building or premises shall be used on the following purposes: Single-family dwellings 3 Two-family dwellings Multiple-family dwellings if constructed or under construction prior to November 1, 1983, and if originally designed and built pursuant to a zoning and building permit as a multiple-family dwelling, not a conversion as evidenced by the plans on file with the Chief Building Official. Cemetery Golf course, except miniature golf courses and driving range operated for commercial purposes Country club Places of worship Private schools having curriculum similar to that offered by public schools Public schools Supervised group homes Section 29.17, R2-7, Low-Density Residential District, Two-Family Dwellings Rationed. (1) Permitted Uses. A building or premises shall be used only for the following purposes: Single-family dwellings Two-family dwellings Multiple-family dwellings if constructed or under construction prior to November 1, 1983, and if originally designed and built pursuant to a zoning and building permit as a multiple family dwelling, not a conversion, as evidenced by the plans on file with the Chief Building Official. Cemetery Golf course, except miniature golf courses and driving ranges operated for commercial purposes Country club Places of worship Private schools having curriculum similar to that offered by public schools Public schools Supervised Group Homes Section 29.18, R-3 Medium-Density Residential District. (1) Permitted Uses. A building or premises shall be used on the following purposes: Single-family dwellings Two-family dwellings Multiple-family dwellings Multiple-family dwellings that do not meet the R-3 regulations which were lawfully constructed or under construction prior to November 1, 1983, pursuant to zoning and building permits as evidenced by the plans on file with the Chief Building Official, in compliance 4 with the applicable bulk regulations of the R-4, High Density Residential District when the location was zoned as R-4. Boarding and lodging houses Funeral homes and mortuaries Nursing and convalescent homes Places of worship Private schools having curriculum similar to that offered by public schools Public schools Retirement and homes for the elderly Supervised group homes Residential corrections facility if allowed by a special use permit pursuant to Sec. 29.45 and its standards, provided further that it not be nearer than 500 feet to another such facility or a supervised group home Section 29.19, R-4 High-Density Residential. (1) Permitted Uses. A building or premises shall be used only for the following purposes: Single-family dwellings Two-family dwellings Multiple-family dwellings Boarding and lodging houses Sororities and fraternities Funeral homes and mortuaries Nursing and convalescent homes Places of worship Private schools having curriculum to that offered by public schools Public schools Retirement and homes for the elderly Supervised group homes Residential corrections facility, if not nearer than 500 feet to another such facility or supervised group home. Inclusion of public schools as a permitted use in the residential districts listed above, will bring them into compliance with the zoning ordinance of the City, and it will make it clear that compliance with zoning requirements and review of site plans for public school improvements is intended by the City. The Planning and Zoning Commission reviewed this item at their meeting of May 6, 1992 and recommended that it be approved. ALTERNATIVES: 1. The City Council can approve of the addition of public schools to the permitted use list for the "A-1" and "R1-10", "R1-6", "R-2", "R2-711, "R-3" and "R-4" and set June 9, 1992 as the date of public hearing. 5 2. The City Council can deny approval of these changes to the zoning ordinance and set June 9, 1992 as the date of public hearing. 3. The City Council can refer this request back to the City staff for further information. MANAGER'S RECOMMENDED ACTION: It is the recommendation of the City Manager that the City Council adopt Alternative #1. This will approve of the amendment to include public schools as a permitted use in the "A-1", "R1-10", "R1-611, "R-211, "R2-711, "R-3" and "R-4" zoning districts.
