SUBJECT: Vacation of the south half of Tenth Street from Ridgewood to
Chicago Northwestern Railroad.
BACKGROUND:
The City Council received a request from the owner of 926 Ridgewood
Avenue to vacate the 50' wide City street right of way known as Tenth
Street which abuts the north property line of 926 Ridgewood Avenue.
This request was referred to Staff at the October 8, 1991 City Council
meeting.
All of the utility companies were contacted to determine locations of gas,
sewer, water, electric, telephone and cable television lines. Most of these
utilities have lines in Tenth Street right of way. Please refer to the
attached plan which shows the location of the utility lines.
Staff has no objection to vacating and selling the south half of the Tenth
Street right of way as long as an easement for the watermain is retained.
The north half of Tenth Street would remain as a utility corridor and
access to overhead utility lines located next to the railroad.
The owner of 926 Ridgewood understands that as a condition of sale of the
land to him he has to remove paving, intakes and sidewalk in Tenth Street
and install curb and gutter and sidewalk on Ridgewood Avenue. Also a
fire hydrant will be relocated so that it will not conflict with the driveway
to his proposed garage. The estimated cost to do this work is $5,600.
The estimated value of the south half of Tenth Street is $7,300 without
any encumbrances. According to policy, the selling price is reduced by
15 o for maintaining an easement across the land, and by 10% for a quit
claim deed. Credit is also given for the cost of relocations and improve-
ments. When all of this is done the resultant value is less than zero. In
this case, staff feels that it is appropriate to deed the land to the owner
at no expense after the fire hydrant relocation and street improvements
are completed.
ALTERNATIVES:
1. Grant the request from the owner of the property located at 926
Ridgewood Avenue and begin the process to vacate the south half of
the City street right of way known as Tenth Street between
Ridgewood Avenue and the Chicago and Northwestern Railroad. It is
also understood that the work to be performed by the owner, as
directed by staff, is the dollar amount of compensation for the land.

2. Deny the request from the owner of the property located at 926
Ridgewood Avenue and retain ownership of the right of way known
as Tenth Street between Ridgewood Avenue and the Chicago and
Northwestern Railroad.
MANAGER'S RECOMMENDED ACTION:
It is recommended by the City Manager that the City Council adopt alter-
native number 1 above, thereby granting the request from the owner of
the property located at 926 Ridgewood and begin the process to vacate the
south half of the City street right of way known as Tenth Street between
Ridgewood Avenue and the Chicago and Northwestern Railroad. It is also
understood that the work to be performed by the owner, as directed by
staff, is the dollar amount of compensation for the land.
