HomeMy WebLinkAbout~Master - Revising Regulations Pertaining to Disposal of Leaves and Grass ORDINANCE NO. 3155 AN ORDINANCE TO AMEND THE MUNICIPAL CODE OF THE CITY OF AMES, IOWA, BY ADDING A NEW SUBSECTION 10.8(3)(D) , AND A NEW SECTION 10.24; REPEALING AND RE-ENACTING SECTION 10.21 AMENDED; FOR THE PURPOSE OF REVISING REGULATIONS PERTAINING TO DISPOSAL OF LEAVES AND GRASS; REPEALING ALL ORDINANCES IN CON- FLICT HEREWITH; ESTABLISHING A PENALTY AND SETTING AN EFFECTIVE DATE. BE IT ORDAINED, by the City Council for the City of Ames, Iowa: Section One. The Municipal Code of the City of Ames, Iowa is hereby amended by: (a) Adding the following as Subsection 10.8(3)(d) : "Leaves and grass may be disposed of by delivery to a site for composting or land application, or delivery to any person who can be reasonably expected to cause composting or land application of the leaves and grass, in accordance with the provisions of Section 10.24." (b) Adding the following as Section 10.24: "Sec. 10.24. LAND APPLICATION OF LEAVES AND GRASS. (1) Land application of leaves or grass collected from places other than the site of application shall be done by spreading the leaves or grass evenly over the site of application within seventy-two (72) hours of those ma- terials arriving on the site. Composting of leaves and grass shall be done in accordance with the rules of the Iowa Department of Natural Resources. (2) Owners of sites used for composting or land application of leaves or grass, collected from places other than the site of application, and all persons engaged in such composting or land application of leaves or grass, shall take reasonable measures to retain the said leaves or grass on the site of application." Section Two. The Municipal Code of the City of Ames, Iowa is further amended by repealing Section 10.21 thereof and re-enacting the same to read as follows: "Sec. 10.21. DISPOSAL FACILITIES ESTABLISHED; UNLAWFUL TO USE OTHER AREAS, PENALTY. There are hereby established authorized disposal facili- ties at such place or places as the city council may direct where garbage, refuse and yard waste shall be disposed of within the City of Ames. It shall be unlawful to dispose of garbage, refuse or yard waste, except leaves and grass, in any other place. The disposal facilities are for the exclu- sive use of the residents of the incorporated limits of the City of Ames and residents of such areas which have by contract or license from the City of Ames obtained the right to use such facilities. The use of these facilities may be refused to any and all other persons. Violations of this section or section 10.9 shall be a municipal infraction pun- ishable by a minimum fine of not less than $100 for the first offense and $200 for each repeat violation." Section Three. Violation of the provisions of this ordinance shall constitute a municipal infraction, punishable as set out in Section 1.9, Ames Municipal Code. Section Four. This ordinance shall be in full force and effect from and after its passage and publication as required by law. Passed this 17th day of December 1991.
