HomeMy WebLinkAboutA001 - Council Action Form dated April 9, 1991 ITEM #: DATE: 04/09/91 COUNCIL ACTION FORM SUBJECT: Resolution Approving Amendment of the Municipal Code of the City of Ames, Enacting a New Subsection 22.4(3) Pertaining to Sidewalk Cafes. ACTION FORM SUMMARY: Approval of this Amendment would enact a Sidewalk Cafe Ordinance, as researched by Staff and Chamber of Commerce per Council's request. Passage of the Sidewalk Cafe Ordinance will allow for the safe operation of sidewalk cafes along the public right-of-way. BACKGROUND: On July 10, 1990 the Council adopted Resolution No. 90-259 directing Staff to continue issuing temporary obstruction permits for sidewalk restaurant seating, with expiration dates at the end of October. Data was to be collected and referred to the Chamber of Commerce for review. The Chamber of Commerce in response to the Council's request formed a Sidewalk Cafe Task Force to address the issues surrounding sidewalk cafes. The task force was comprised of restaurateurs, business persons and City Staff. In review of several City Staff proposals the task force has approved of the Sidewalk Cafe Ordinance in the form that is being presented to the City Council for adoption. Foremost the safety of the public utilizing the public right-of-way was taken into consideration concerning the proposed Sidewalk Cafe Ordinance. Issues being addressed in the proposed ordinance include alcoholic bever- ages, sidewalk clearances, signage, insurability, trash and refuse, days and hours of operation, delineation, term and renewal, and revocation. Under the temporary obstruction permit section of the City of Ames Municipal Code permits are to be temporary (less than one week) , enabling a once a year application process. The proposed ordinance would allow the sidewalk cafe to operate from April 1 to October 31. Currently several restaurants are asking for permission to operate sidewalk cafes in the City of Ames. 2 ALTERNATIVES: 1. The City Council can approve of the Amendment of the Municipal Code of the City of Ames, Enacting a New Subsection 22.4(3) Per- taining to Sidewalk Cafes. 2. The City Council can deny approval of the Amendment of the Municipal Code of the City of Ames. 3. The City Council can refer the proposed Amendment back to Staff for revision or further information. MANAGER'S RECOMMENDED ACTION: It is the recommendation of the City Manager that the City Council adopt Alternative #1. This will approve of the Amendment of the Municipal Code of the City of Ames, Enacting a New Subsection 22.4(3) Enabling the Operation of Sidewalk Cafes within the City of Ames.
