HomeMy WebLinkAboutA021 - Council Action Form dated December 18, 1990 ITEM #: r� DATE: 12 18/90 COUNCIL ACTION FORM SUBJECT: Public Hearing and First Passage of an Ordinance Rezoning a Portion of the Bandshell Neighborhood From R-3 (Medium-Density Residential) to R-2 (Low-Density Residential) . ACTION FORM SUMMARY: The Planning and Zoning Commission and the City staff have reviewed the three (3) Bandshell rezoning options and are recommending that the City Council select Option No. 3. Further traffic study is being done to determine if the area shown R-3 in Option No. 3 will remain. BACKGROUND: On November 13, 1990, City Council held a Public Hearing and considered eight (8) options for rezoning of the Bandshell Neighborhood. Action taken by the Council was referral of three (3) rezoning options to City staff and the Planning and Zoning Commission for consideration and recommendation back to the City Council. Graphic representations for these three (3) rezoning options are attached to this report. A petition, signed by some of the property owners in this neighborhood, objecting to the proposed rezoning, was submitted at the City Council meeting on November 13, 1990. This petition does not have a bearing on the number of votes required by City Council to approve any of the three (3) rezoning options since the land area owned by property owners signing the petition is less than the percentage required to force a 3/4 vote of the Council (five votes). ANALYSIS: A discussion of the three (3) remaining rezoning options follows: COUNCIL OPTION NO. 1: This option would rezone all properties east of Crawford Avenue to R-2, except for the Eastwood Apartment Complex and the five (5) properties abutting East Seventh Street located directly west of Eastwood Apartments. 2 Option No. 1 is contrary to what is shown on the Land Use Policy Plan (LUPP) Map for this area. The LUPP Map designates all properties generally east of Crawford Avenue as suitable for Medium-Density Residen- tial development. Staff believes that the properties which front on East Sixth Street and East Seventh Street should remain as R-3 zoning to allow for redevelop- ment of single-family properties as multiple-family residential. Rezoning of properties in the remainder of the Bandshell area from R-3 to R-2 complies with the Land Use Policy Plan Map. In addition, this rezoning option would rezone 601 Carroll Avenue from P-C (Planned Commercial) to R-2 (Low-Density Residential). COUNCIL OPTION NO. 2: This option would rezone properties abutting both sides of Crawford Avenue from R-3 to R-2, and would rezone all properties between Duff Avenue and Crawford Avenue from East Fifth Street to East Ninth Street from R-3 to R-2. In addition, 601 Carroll Avenue would be rezoned from P-C to R-2. Option No. 2 would bring this area into compliance with the Land Use Policy Plan (LUPP) Map. The Bandshell Neighborhood Association suggests that the property at 722 Crawford could be developed by using one of the following alternatives: Neighborhood Alternatives for 722 Crawford Avenue: A. Develop the property as a single-family lot with no changes in the lot dimensions; B. Sell the entire property to the City for use as part of the cemetery; C. Sell the back portion of the property to the City for cemetery use and buy an equal amount of cemetery land from the City with frontage on Crawford Avenue. This would create two reasonably- sized residential lots; D. Extend East Eighth Street east along the north side of the lot to provide access to the back portion of the lot, and then divide this property into two lots. Staff Comments on Neighborhood Alternatives for 722 Crawford Avenue: A. Staff believes that it is unlikely that the property at 722 Crawford Avenue will be developed for single-family use given the fact that the property includes 26,028 square feet with a lot width which varies from 60 to 83 feet wide. 3 B & C. The City of Ames has no plans to buy the property at 722 Crawford Avenue for use as part of the cemetery, nor does the City intend to sell any cemetery property for residential development. D. Any extension of the alley described as East Eighth Street, must have a right-of-way width of 60 feet to meet current subdivision standards. The present width of 16 feet for the alley west of this property would not meet the minimum subdivision standards for access to this property. Staff generally agrees with this rezoning Option No. 2, but staff believes that the present zoning of R-3 should remain for 722 Crawford Avenue, and that the present zoning of P-C (Planned Commercial) should remain for 601 Carroll Avenue. COUNCIL OPTION NO. 3: This option is very similar to Option No. 2. The differences are that Option No. 3 does not propose the rezoning of property at 722 Crawford and 601 Carroll Avenue. These properties would remain as R-3 and P-C, respectively, under Option No. 3. Option No. 3 was recommended for City Council approval by the Planning and Zoning Commission and City staff. Staff continues to support this option since it will bring the area into conformance with the Land Use Policy Plan (LUPP) Map. PLANNING AND ZONING COMMISSION RECOMMENDATION: This item was reviewed by the Planning and Zoning Commission at their meeting of December 5, 1990, and they have forwarded the following recommendation: 1. The City Council should zone the subject area as shown in Council Option No. 3; and 2. The Planning and Zoning Commission further advises that the area in Council Option No. 3 that is shown as being zoned R-3 is still under detail study by the Commission. This study will determine what traffic affects might be created if this area east of Crawford Avenue were to develop as medium-density residential. A final recommendation on this area will be presented to the Council at an upcoming meeting. ALTERNATIVES: 1. The City Council can approve of Council Option No. 1 for rezoning of the Bandshell Neighborhood area. 2. The City Council can approve of Council Option No. 2 for rezoning of the Bandshell Neighborhood area. 3. The City Council can approve of Council Option No. 3 for rezoning of the Bandshell Neighborhood area. 4 4. The City Council can refer the Bandshell Neighborhood rezoning proposal back to City staff for additional information. MANAGER'S RECOMMENDED ACTION: It is the recommendation of the City Manager that the City Council adopt Alternative #3. This will approve of the rezoning of the Bandshell area as shown on Council Option No. 3. Further, the City Council must under- stand that the Planning and Zoning Commission will be providing an additional recommendation to the City Council relating to the zoning of the area along East Sixth Street.
