HomeMy WebLinkAboutA001 - Letter to Mayor from Prairie View East Homeowner's Association TO: HONORABLE LARRY CURTIS, MAYOR AND CITY COUNCIL FOR AMES, IOWA FROM: PRAIRIE VIEW EAST HOMEOWNER'S ASSOCIATION SUBJECT: REZONING OF THE VACANT LAND CONTIGUOUS TO AND WEST OF PRAIRIE VIEW EAST SUBDIVISION The majority of the owners of the property located in First Addition, Prairie View Subdivision, in Ames are requesting that the City Council refer to the City Planning and Zoning Commission the question of whether the land now vacant immediately to the West of the Prairie View Subdivision have its zoning changed from R-3 to R-2 and R1-6. The property in question is outlined in bold black on the attached Plat. The zoning on First Addition, Prairie View Subdivision, is currently R-3, even though by restrictive covenant and use it is developed as an R-2 and R-1 zone. The owners in Prairie View East have petitioned for rezoning on that Subdivision and hearing on their Petition will be before the Planning and Zoning Commission in early August 1990. By way of history, in 1983 when the City was re-doing the zoning throughout the City and effectuating a land policy, a request was made at that time by the Prairie View East residents to have their property zoned R1-6, with approximately 12 of the lots zoned R-2 so that duplexes could be accommodated. At that time the land immediately adjacent was also considered. The City Council, after urging by the developer, and after being assured that he would give restrictive covenants with respect to Prairie View East, allowed the zoning to remain R-3, even though it did not conform with the City's Land Use Policy. Prairie View East is now a completed Subdivision with lots 1, 2, 3, 4, 5, 6, 30, 31, 32, 33, 34 and 35 devoted to duplex use, and the remaining lots by restrictive covenant designated single family residences. The current Land Use Policy Plan of the City has designated this area, both Prairie View East Subdivision and the land that is the subject of this request, to be R-L, Residential: Low Density, 1 to 9 units per acre. The land immediately across the road to the North is owned by the Ames Community School District, and the land on the North side of the road immediately to the West of that land is also R-L. The only area under the Land Use Policy that is R-M, which would be Residential: Med. Density, 10 to 22 units per acre, and which would be R-3, is the area that the University has used for many years, Schilletter Village. The Council is urged to be consistant with the Land Use Policy Plan, and at the very least refer this request to the Planning and Zoning Commission for appropriate study and then public hearing. -2- The residents of the Prairie View East Subdivision strongly feel that the land that is contiguous to theirs should be developed in the same manner. That being, that the lots nearest to 24th Street be reserved for duplexes, and the remainder of the lots for R1-6, single family residences. This would be very consistant with the Land Use Policy Plan and very consistant with the area as it has developed. This would protect the investments that have been made by the people in Prairie View East and make a pleasant homogeneous development. To allow the development of the land in question to be multi-unit structures would impact greatly on the traffic in the area. It would create some real problems relative to access to and from 24th Street. The only access into this land is from 24th Street, and to put a big apartment complex in here, which the Prairie View East residents understand may be forthcoming, will create some real problems. The Homeowner's Association is not asking the City Council to make a decision relative to the ultimate zoning on this property at this time. They are asking that this request be referred to the Planning and Zoning Commission for study. If the Commission recommends a zoning change, proper notification be given and hearing be held as to those changes. If, on the other hand, the Planning and Zoning Commission recommends there be no zoning change, then there would be no necessity for the public hearing. The Association feels that this issue should be looked at now before any ground breaking takes place, and any party obtains any vested interest in the current zoning policy. The Association also feels very strongly that the Land Use Policy should be followed. The Association requests at this hearing for the City Council to refer its request to the Planning and Zoning Commissi n for further study and evaluation.
