AN ORDINANCE TO AMEND THE MUNICIPAL CODE OF THE
CITY OF AMES, IOWA, BY REPEALING SECTION 29.28 AS IT
NOW APPEARS AND ENACTING A NEW SECTION 29.28 PER-
TAINING TO A VISIBILITY TRIANGLE AT STREET INTERSEC-
TIONS; REPEALING ALL ORDINANCES IN CONFLICT HERE-
WITH; ESTABLISHING A PENALTY AND SETTING AN EFFEC-
TIVE DATE.
BE IT ORDAINED, by the City Council for the City of Ames, Iowa:
Section One. The Municipal Code of the City of Ames, Iowa is
hereby amended by repealing Section 29.28 thereof and re-enacting said
section revised to read as follows:
"Sec. 29.28. VISIBILITY AT INTERSECTIONS.
Within the visibility triangle on any corner lot in any
A-1, S-R, R1-10, R1-6, R-2, R2-7, R-3, R-4 or H-M Dis-
trict, no fence, wall, or other structure shall be erected, or
no foliage plant is permitted to grow to a height of more than
three (3) feet above the elevation of the established street
grade measured at the curb line at the intersection of the
streets abutting the corner lot. Such visibility triangle
shall be defined as the area created by the intersection of
property lines at the corner of the abutting two streets and a
line connecting two (2) points on said property lines twenty
(20) feet from the point of intersection."
Section Two.. Violation of the provisions of this ordinance shall
constitute a municipal infraction, punishable as set out in Section 1.9,
Ames Municipal Code.
Section Three. All ordinances or parts of ordinances in conflict
herewith shall be repealed to the extent of such conflict if any.
Section Four. This ordinance shall be in full force and effect
from and after its passage and publication as required by law.
