SUBJECT: Ordinance establishing regulations pertaining to the siting and
operation of private sanitary disposal projects.
BACKGROUND:
As the City's construction and demolition landfill area is filled and private
enterprise looks to pickup the service, it is necessary to establish regula-
tions that will govern the location and operation of these proposed facili-
ties. The Legal, Planning and Housing, and Public Works Departments
reviewed new state regulations and existing zoning and site planning
requirements to create the attached proposed ordinance. These regulations
are set up to be in addition to the requirements of the Iowa Department of
Natural Resources.
After the matter was tabled on June 26th, staff met with representatives of
the private enterprise to discuss the concerns they had with the proposed
regulations. The proposed regulations were modified to change the
specific requirements of the buffer to be more general and allow the
developer to propose specific combinations of berms, coniferous trees, and
shrubs. In addition, a change was made to eliminate the restriction that
petroleum contaminated soil could come only from Story County. This
material is only treated at the site and then moved either off the site as
fill material or used as cover for the landfill. Allowing petroleum contami-
nated soil to come from areas outside Story County will not take up space
within the disposal project or decrease the life of the area.
Several other verbiage changes were made, but did not affect the intent or
requirements of the regulations. The private developers who are propos-
ing a construction demolition landfill indicate that they can work within the
scope of the proposed regulations.
ALTERNATIVES
1. Approve the ordinance as modified.
2. Reject the ordinance and use the State laws for regulation. These
State laws do not provide for detailed local involvement as does the
proposed City ordinance.
MANAGER'S RECOMMENDED ACTION:
It is recommended by the City Manager that the City Council adopt the
landfill siting and operation ordinance.
