RE: REQUEST FOR SITING APPROVAL OF
SANITARY DISPOSAL PROJECT
Honorable Mayor & City Council:
In accordance with revisions to Chapter 455B. 305A of the Iowa
Code enacted by the General Assembly and signed by the Governor
on April 24 , 1990 effective as law upon approval of the Governor,
I, Mr. William K. Fedeler, hereinafter referred to as the
Applicant, d.b.a. Ames-Story Environmental Landfill, Inc. , 1509
E. Lincoln Way, Ames, Iowa 50010 do hereby request approval from
the Ames City Council to construct and operate a Sanitary
Disposal Project within the Corporate Limits of the City of Ames.
The proposed site for the sanitary landfill is Lot 3 , Dayton Road
Development Subdivision, Watts Street, Ames, Iowa, 50010.
Plans for the landfill are being developed by Clapsaddle-Garber
Associates, Inc. , Ames, Iowa to serve as the basis for an
Application to the Iowa Department of Natural Resources for a
Permit to Operate a Sanitary Disposal Project in accordance with
Iowa Administrative Code Chapter 567-102 . With reference to
Section 1 . 2 of the new law, the following comments are offered:
a. The project is necessary to accommodate the solid waste
management needs of the area by providing a disposal
site restricted to the following items
- Construction and demolition wastes
- Diseased trees and tree stumps which cannot be
chipped, land applied or composted
- Hydrocarbon contaminated soil to be treated on-site,
tested, and reclaimed in accordance with IDNR
requirements
- Asbestos for which an IDNR Special Waste
Authorization has been issued
b. The project is designed, located, and proposed to be
operated in accordance with IDNR standards so that the
public health, safety, and welfare will be protected.
C. The project is located immediately adjacent to the
existing City of Ames landfill in an area zoned G1 -
General Industrial so as to minimize incompatibility
with the character of the surrounding area and to
minimize the effect of the value of the surrounding
property.
d. The project is located outside the 100-year flood plain
of the South Skunk River.
e. The plan of operations for the project is designed to
minimize the danger to the surrounding area from fire,
spills, or other operational accidents.
f. Utilizing the same access as the existing City of Ames
landfill, traffic patterns to and from the project
shall minimize the impact on exiting traffic patterns.
Written notice has been issued to all property owners within
1, 000 feet of the project site and members of the general
assembly from the legislative district in which the proposed
project is located. Notice will also been published in the Ames
Tribune (affidavit of publication attached) .
The law requires a 90-day comment period prior to a public
hearing, and that written comments received within 30 days after
the public hearing be considered prior to the City Council
issuing its decision. However, since the Ames City landfill will
no longer accept construction and demolition wastes by
mid-summer, the Applicant requests that for the convenience of
residents, contractors, and businesses the City and State
Legislators use what means are available to hold the public
hearing within 30 days of published notice and that the Council's
decision be considered immediately following the hearing.
