COUNCIL ACTION FORM
SUBJECT:
Motion to Set June 26, 1990, as the Date of Public Hearing on Technical
Amendments to Section 29.49 of the Zoning Ordinance.
BACKGROUND:
In 1989, the City Council adopted an Ordinance that enacted newly rewrit-
ten provisions for site plans required in the Zoning Ordinance.
When staff rewrote these site plan provisions, two Sections were inadver-
tently left out of the updated Ordinance.
These two Sections refer to:
1. Effective Period of Plan Approval (1 year); and
2. Violations.
A copy of the two Sections that are being proposed for inclusion in the
Zoning Ordinance are attached to this Action Form.
Planning and Zoning Commission Recommendation: The Planning and
Zoning Commission reviewed the proposed technical amendments at their
meeting of May 16, 1990, and recommended that they be approved.
ALTERNATIVES:
1. The City Council can approve of the proposed technical amendments
and set June 26, 1990, as the date of Public Hearing.
2. The City Council can deny approval of the proposed technical
amendments and set June 26, 1990, as the date of Public Hearing.
3. The City Council can approve the proposed technical amendments
with modifications and set June 26, 1990, as the date of Public
Hearing.
4. The City Council can refer this matter back to City staff for further
review.

MANAGER'S RECOMMENDED ACTION:
It is the recommendation of the City Manager that the City Council adopt
Alternative #1. This will approve of the technical amendments for the site
plan provisions in the Zoning Ordinance and set June 26, 1990, as the
date of Public Hearing.

TECHNICAL AMENDMENTS
Section 29.49(7)
Effective Period of Plan Approval. The approval of any major or
minor site plan required under the terms of this Section shall be
effective for one (1) year from the date of approval by the Director
of Planning and Housing or by the Zoning Board of Adjustment, as
applicable. Building permits shall be issued within the one (1) year
approval period, and construction shall commence within eighteen
(18) months of approval of the plans. The approved plans shall be
null and void if the building permits are not issued within the
specified period of time and if construction is not commenced within
eighteen (18) months.
Section 29.49(8)
Violation. A structure or activity undertaken without site plan
approval pursuant to this Section, or the undertaking of a structure
and/or activity not shown on the approved site plan or in conflict
with the approved site plan, shall constitute a violation of this
Section for which any and all lawful enforcement means and proceed-
ings may be invoked and instituted.
