Curtis, Mayor and Members of the City Council of the City of Ames, Iowa Re: Hate Crimes Ordinance Dear Mayor Curtis and Council Members: As you will recall , the City Council passed a motion directing the City Attorney to prepare an ordinance that followed the provisions of recently enacted Senate File 2197 relative to the punishment of "hate crimes". Attached is an ordinance which is a nearly verbatim copy of the State law. The difference is a city can only assess a misdemeanor penalty. Also left out of the ordinance is the provision for monetary damages, injunctive relief, and attorney fees for those persons who have suffered physical , emotional , or financial harm as a result of a violation of Senate File 2197. Not including this in the ordinance will not prevent people from bringing civil lawsuits for such injunctive or monetary damages on the grounds that there has been a violation of the State statute.
