HomeMy WebLinkAbout~Master - Vacating a Portion of Carroll Avenue ORDINANCE NO. 308 AN ORDINANCE vacating all of that Portion of Carroll avenue lying be- tween the north and the south lines of the Chicago & Northwestern Rail- way company right of way in the ' city of Ames, Iowa; and granting and c6nveying that portion of said avenue so vacated to the Chicago & Northwestern Railway company: Whereas, the council of the incor- porated city of Ames, Io`va, has va- cated all of that portion of Carroll avenue lying between the north line '• of the right of way of the Chicago & Northwestern Railway company and the north line of the city electric light ! j building, thereby closing said avenue I to all traffic over and across the said railway company's right of way on said avenue; and, ! Whereas,all of the remainder of said avenue from the north line of the right of way of said railway company to the south line of said right of way is of no further use or value to the incor- porated city of Ames, Iowa, as a street or avenue; and, ! Whereas, to retain title to said av- enue across said right of way, can t and does serve no useful purpose toj the public and only prevents said rail-{ way company from making such re-I pairs and improvements as 'to prop- erly safeguard its tracks and adequate-! ly protect the public; Therefore, { Be it Ordained, by the city counciIl of the incorporated city of Ames,Iowa: k - Section 1. That all of that portion y of Carroll avenue lying between the north and the south lines of the Chi- cago&Northwestern Railway company right of way be and the same is here- by-vacated. ' s i Section 2. That the mayor and the city clerk of the incorporated city of Ames, Iowa, are hereby authorized and directed to make, execute and deliver to the Chicago & Northwestern Rail- way company a good and sufficient I deed to so much of said avenue as is F hereinbefore described and vacated. Section 3. All ordinances and parts of ordinances in conflict herewith are " E hereby repealed. t Section 4.
