HomeMy WebLinkAboutA001 - Council Action Form dated February 27, 1990 ITEM #: CAF DATE: 02/ /90 COUNCIL ACTION FORM SUBJECT: Motion to Set March 7, 1990, as the Date of Public Hearing to Consider Rezoning of Property Located at 2319 Timberland Road. BACKGROUND: David J. and Juanita L. Lovejoy are requesting that the City of Ames rezone this property from the current zoning designation of R-1 (Residen- tial -- Story County) to a new designation of S-R (Suburban Residential) . The property is legally described as shown on Attachment 1. The site includes approximately 28,901 square feet. A request has been received by the City to annex this property inside the corporate boundaries. The applicants propose to construct a single-family residence on this property served by municipal utilities. It is the policy of the City of Ames to serve only property located inside the corporate boundaries with City utilities. ANALYSIS: Existing Land Use/Zoning. The LUPP designates this property as suitable for Low-Density Residential. The following POLICIES for agricultural and residential development respectively, as found in the LUPP, apply to this rezoning proposal: 2 H. PRIME AGRICULTURAL LAND/REDEVELOPMENT H.1.2. Policy: Development of those areas within the Municipal Urban Service Area that presently are not being utilized for urban uses will be encouraged. - Preference will be given to development projects that can be served by the existing infrastructure system or an efficient and economical extension. Note: The subject property is located inside the Municipal Urban Service Area (MUSA) line and can be served by existing public utilities. B. RESIDENTIAL B.1.2. Policy New housing development will be located adjacent to existing development to better utilize existing public facilities and to ensure the orderly growth of the community. - This is accomplished by adherence to the City Council policy that no development outside the corporate limits will be served by public utilities. Identification of areas suitable for residential development in proximity to existing development can be accomplished through the Land Use Policy Plan. Utilities. Public utilities in this area include the following: Water: 6-inch line in Timberland Road; Sanitary Sewer: 8-inch line in Timberland Road; Storm Sewer: None exists to serve this property; and Electric: Service is provided by Iowa Electric Light and Power Co. Height: 21 Stories or 35' 3 Stories or 40' . 3 Planning and Zoning Commission Recommendation: The Planning and Zoning Commission reviewed this request at their meeting of February 7, 1990, and recommended that it be approved. ALTERNATIVES: 1. The City Council can approve of the request to rezone property at 2319 Timberland Road from R-1 (Residential -- Story County) to S-R (Suburban Residential), and set March 7, 1990, as the date of Public Hearing. 2. The City Council can approve of the request to rezone property at 2319 Timberland Road from R-1 (Residential -- Story County) to S-R (Suburban Residential) with the following stipulation, and set March 7, 1990, as the date of Public Hearing: A. The applicants must pay the required connection fees to tap into the City sewer system prior to City Council approval of the annexation of this property. 3. The City Council can deny approval of the request to rezone proper- ty at 2319 Timberland Road from R-1 (Residential -- Story County) to S-R (Suburban Residential), and set March 7, 1990, as the date of Public Hearing. 4. The City Council can refer the rezoning request to City staff for additional information. MANAGER'S RECOMMENDED ACTION: It is the recommendation of the City Manager that the City Council adopt Alternative #2, a recommendation for approval of the request to rezone property located at 2319 Timberland Road with the stipulation that the applicants must pay the required connection fees to tap into the City sewer system. This action will also set March 7, 1990, as the date of Public Hearing. COUNCIL ACTION: y\bpo\caf\rezone.227
