HomeMy WebLinkAbout~Master - Amending Insurance Requirements for Tree Surgeon, Garbage Hauler, Vendors ORDINANCE NO. 3065 AN ORDINANCE TO AMEND THE MUNICIPAL CODE OF THE CITY OF AMES, IOWA, BY REPEALING SECTIONS 10.12 AND 27.7, AND SUBSECTION 22.14(5) AND REENACTING THE SAME FOR THE PURPOSE OF REQUIRING THAT THE EFFECTIVE DATE OF INSURANCE POLICIES OF LICENSED TREE SUR- GEONS, GARBAGE HAULERS AND STREET VENDORS COINCIDE WITH THE EFFECTIVE DATES OF THE CITY LICENSE; PROVID- ING A PENALTY; AND, PROVIDING AN EFFECTIVE DATE. BE IT ENACTED by the City Council of the City of Ames, Iowa: Section One. The Municipal Code of the City of Ames shall be and the same is hereby amended by repealing Section 27.7 and 10.12, and Subsec- tion 22.14(5) and reenacting the same revised to read as follows: "Sec. 10.12. INSURANCE AFFIDAVIT; CONTENTS; LIABILITY COVERAGE. (1) Contents. The certificate or affidavit of insurance to be filed with the application for a license hereunder shall be executed by representatives of a duly qualified insurance company evidencing that the insurance compa- ny has issued liability and property damage insurance policies covering the following: (a) All operations of the applicant, or any other person employed by the applicant in garbage and refuse collection within the corporate limits of the city; (b) The disposal of the garbage and refuse to and within any area designated as a sanitary landfill by the city; (c) Protecting the public and any person from injuries or damages sustained by reason of carrying on the work of garbage and refuse collection and disposal. (2) Applicant shall procure and maintain, for the duration of the license period, insurance against claims for injuries to persons or damages to property which may arise from or in connection with the function for which the license is issued. Applicant shall furnish the City of Ames with certifi- cates of insurance evidencing the following coverages: (a) Comprehensive General Liability with limits of no less than $1,000,000 combined single limits per occurrence for bodily injury, personal injury and property damage. (b) Automobile Liability with limits of no less than $1,000,000 combined single limits per occurrence for bodily injury, personal injury and property damage. (c) Worker's Compensation and Employee's Liability as required by the laws of the State of Iowa. The certificate must be on file in the office of the City Clerk, showing effective dates of the insurance policy coinciding with the effective date of the li- cense, before a license shall be issued." "Sec. 22.14. APPLICATIONS. (5) Proof of an insurance policy having effective dates coinciding with the effective dates of the street ven- dor's license applied for, issued by an insurance company licensed to do business in the State of Iowa, protecting the licensee and the city from all claims for damages which may arise from operations under or in connection with the license. Such insurance shall be an "occurrence" policy and name as additional insureds the city, its officers and employees, and shall not terminate or be cancelled prior to the expiration date of the policy or of the vendor's license without 30 day advance written notice to the city." "Sec. 27.7. INSURANCE REQUIRED. Applicant shall procure and maintain, for the duration of the license period, insurance against claims for injuries to persons or damages to property which may arise from or in connection with products, materials and services furnished. Applicant shall furnish the City of Ames with certificates of insurance evidencing the following coverages: (1) Comprehensive General Liability with limits of no less than $1,000,000 combined single limits per occurrence for bodily injury, personal injury and property damage. (2) Automobile Liability with limits of no less than $1,000,000 combined single limits per occurrence for bodily injury, personal injury and property damage. (3) Worker's Compensation and Employee's Liability as re- quired by the laws of the State of Iowa. The certificate must be on file in the office of the City Clerk, showing that the policy has effective dates coinciding with the effective dates of the tree surgeons license applied for, before the license shall be issued." Section Two. Violation of this ordinance shall be a municipal infraction punishable as provided by Section 1.9 of the Municipal Code. Section Three.
