ITEM () DATE June 27, 1989 COUNCIL ACTION FORM SUBJECT: SKATEBOARDING IN THE DOWNTOWN AREA BACKGROUND: Over the past month or so, staff has undertaken an investigation of the impact of skateboarding in the Downtown area. As a previous memo has outlined, there does appear to be a problem in terms of property damage and safety issues. A review of communities in Iowa (generally 50,000 or more in popula- tion) has shown that skateboarding has been addressed in a number of them. Attached are portions of ordinances from Des Moines and Waterloo which the City has been able to obtain to this point; other examples of legislation have been requested from other areas. In looking outside of Iowa, regulation of skateboarding again is not unusual. However, in looking outside the state, we also see the higher prevalence of parks established for skateboarders. On the issue of parks, staff found that some municipal skateboarding parks do exist. It has been recommended that the City obtain information from Virginia Beach, Virginia, on its "model" park. It is hoped that this information will be received within the next week or so. In California, it was found that many of the parks are either privately operated, or are operated by a county operation. Staff will try to obtain more information on these county operations as well. A little closer to home, our Risk Manager checked with our present liability insurance carrier, and it would be possible to establish a small-scale park and obtain coverage for it. However, this would not be without a number of restrictions, some of which include the wearing of knee, shoulder, and elbow pads, helmets, and possibly other protective gear. Inspections of skateboards to be sure they are in a "safe" condition are also a possibility. In order to assure compliance with restrictions, supervision by a Parks and Recreation employee would normally be necessary. Also, only small (2-ft. high or less) ramps and small curbs and obstacles would be used in the "park." Following the procedure which the City has set for the development of the River Valley softball facilities, it would be possible for the City to allow a portion of a City park or other property to be used as a skateboarding area. Private users would then be allowed to raise the funds necessary to construct the facility. The City would approve the plans for any facility which would be constructed, and would provide the on-going supervision of the area. It is the recommendation of the staff that skateboard travel be banned from the Downtown area, defined as Lincoln Way to 6th Street, from Duff to Pearle Street. It is also recommended that staff pursue investigation of a possible skateboarding area in one of the City's park or open areas. ALTERNATIVES 1. The City Council may direct staff to prepare an ordinance banning travel by skateboards in the Downtown area from Lincoln Way to Sixth Streets, and r Duff to Pearle. Staff would also be directed to continue investigation of alternative skateboarding facilities. 2. The City Council may direct staff to prepare an ordinance banning skate- boarding from the Downtown area, and discontinue efforts at investigating alternative areas. 3. The City Council may continue to allow skateboard travel within the Down- town area. 4. The Council may direct staff to undertake further study and take no action at this time. MANAGER'S RECOMMENDED ACTION: It is the recommendation of the City Manager that the City Council adopt Alternative #1, banning skateboard travel from the Downtown area, while directing staff to continue the investigation of alternative areas. No person shall abandon, leave or place in any street, alley or public place property of any kind. Any property so abandoned, left or placed in any such street, alley or public place, and any property abandoned, left or placed by any person on any private property is declared to be a public nuisance and an obstruction, and a menace to the public welfare, comfort, safety and health. The city manager or his or tier authorized representative shall look after the removal of the obstruction and abatement of such nuisance as soon as possible after receiving a report. As a natural process, our knowledge of Skateboard Facility needs has evolved and 1s continuing to do so. Since the time that we prepared our initial cost estimate we have been continually improving upon the preliminary design. The Advisory Committee composed of both Street Style and Hal f-Pi pe skaters has proven to -be of -great- value-- Our . concept for the physical needs of the facility has been improved by this process. It Is apparent-now that our original plan did not offer a complete package in terms of skill advancement of the skaters. The original plan called for a Street Style area 1n the parking lot and one large Half-Pipe to be situated off to one side. The Advisory Committee strongly recommended that an intermediate size Half-Pipe be built to allow - users to make the transition from Street Style to full Half-Pipe. This need becomes very evident once you - experlence the imposing physical size of the Half-Pipe. After consulting with Park Staff in Ann Arbor and ' Virginia Beach, we became aware that we were literally "on our own" with regard to design and operations. It seems there are no published standards. They did however, offer us suggestions and recommendations on some of the construction details. - t -T f \ One critical set-back wau the failure of the NSA ramp building specialist, Tim Payne to show. He had agreed to assist us with construction of all three areas. For whatever reason , he failed to show as agreed. The Written agreement I prepared and sent to him was not returned. The estimated fee for his work has been consumed in other areas of the project. Changes In this "Design-Build" project were unforeseen and not included in our original estimate. They Include: 1 . It must be Supervised. 2. Physical control of the facility through fencing or other means must be utilized. 3. Adequate personal safety equipment must worn by all participants. 4 . Personal liability waivers must be provided, and confirmed. 5. * Telephone access must be available. 6. The facility must adhere to generally accepted park design standards for safety, aesthetics and landscaping quality. 7. Seating facilities for families and other spectators must be provided ( bleachers ) . OTHER "DESIRABLE" FACTORS: 1 . Participation in the design and operations/control of facilities by "users" will only enhance the possibilities for success . 2. Careful promotion and marketing of the facility/s can result in not only local , but regional and national attention . Summary of findings: In May of 1988, "skateboarding" became a common term in many government circles of the city of Fort Wayne. Skateboarding activities in Freimann Square found City Park representatives at odds with skateboarders who were damaging portions of the park in their pursuit of this sport . After several brief meetings between the skateboarders , Government and Park Officials , a pledge to find an alternate site, dedicated to this activity was made. Informational meetings were held with selected representatives from the skateboard interest, Park planners and administrative staff. It was determined that we should approach our facility design with two sub-user groups In mind. Those who will utilize "street furniture" ( short ramps and other low devices ) and those who are challenged by the larger and more advanced "half-pipe ramp" . This latter structure is used in NSA ( National Skateboard Association ) Amateur and professional programs all over the United States ( see appendix ) . It was further determined that three distinct social groupings exist in the local skateboard domain ; The Skinheads, the Anarchists , and your everyday, dependable American young adult Contacts with several regional cities were by staff to ascertain both the strengths and weaknesses contained in facility operations and design . Visits were planned and made to Ann Arbor, Michigan and South Bend, Indiana. These two cities presented both the best and worst case scenarios. The Ann Arbor Facility represents our goal for achievement . Their facility is a "half-pipe" ramp only , fenced and supervised. They have graciously shared their research, design and operations procedures with us. The Ann Arbor operation will form the major part of our approach to providing a similar facility in Fort Wayne. Major portions of their research and other information is contained in the appendix of this report. The South Bend facility was at the opposite end of the scale . They have merely provided the potential user with an existing outdoor ice arena. This is an apparent "accident waiting to happen" . While on-site signage clearly calls for adequate safety equipment to be worn by the user, no evidence of users wearing such equipment was visible. While visiting this facility , one young man twisted his ankle. The "street furniture" was in poor condition and no supervision was provided. Financing : The location of a project sponsor could allow this project to become a reality in a very short time . The possibility of a corporate gift would allow for not only the development of the facilities but the promotion of the sponsor. However , our policy against "advertising in the parks" , must be maintained at all costs . Estimates for the development of the various ramps, jumps , fencing, controls , lighting , and other related elements are being developed at this time. They will be shared as soon as they become known . Location : One likely and suitable site has been identified in West Swinney Park . It is easily accessible and not in conflict with surrounding land uses . Restrooms and parking are within easy reach and the Rivergreenway trail system connects directly to the proposed location. An existing asphalt parking lot will become the basis for the "street furniture" use area and the "Half-Pipe Ramp" will be located safely in an adjacent grassy area. J. S. We are currently operating five ramps, two located at Mt. Trashmore, one at Lynnhaven Park, one at Red Wing Park, and one portable ramp. Our carpentry crew constructed all of the ramps except the small ramp at Mt. Trashmore which was donated by a private citizen and is mainly used by the younger skaters. The ramps are all wood and cost of materials for the permanent ramps was nearly $7,000 per ramp, which was absorbed by the operating budget of the Department of Parks and Recreation. The City of Virginia Beach is self-insured and had to contract additional liability insurance for the ramps. Fortunately, we have had only a few reported accidents involving broken bones to date. Since their inception, the skateboard ramps have operated very smoothly. We did encounter a few maintenance problems, however, the biggest being a rapidly-deteriorating skating surface. We feel this is due to the large number of skaters using the ramps. Fiberglass has now been applied to the skate ramps and the surface is working very well. Unfortunately, we have no blueprints available to send you. We were given some very rough plans to go by which required a great deal of improvisation by our construction team. Enclosed are photographs of the facilities, a list of operating procedures, rules and regulations, and a materials and personnel cost breakdown. We hope this informations is helpful. DEPARTMENT: Risk Management SUBJECT: Insurance for Skateboard Rams In order to assist you in responding to requests for information regarding the operation of our skateboard rams, we are pleased to provide the following information which you may wish to include in future correspondence: 1. In 1984, when it was first decided to construct the rams, we approached more than 20 insurance companies either directly or through wholesalers. The insurance companies approached included companies that write specialty type insurance for such activities as amusement parks, water flumes, mechanical bulls, etc. 2. Because of the self-insured retention on the city's overall liability program, it was our desire to obtain coverage for the skateboard ramp risks at a lower deductible level. 3. All but one insurer refused to write the risk, and the single insurer that agreed to write the skateboard rams did so as a favor to our broker, and only agreed to write it on a trial basis. We are advised that this underwriter would not agree to write this risk in todays market either for the City of Virginia Beach or for any other city. 4. At the present time, the city has included the skateboard ramps under our general insurance program, and is self-insured for the first $50,000 of any one occurrence. It is anticipated that our self-insured retention will at least double in March when we renew our insurance. 5. We are unaware of any insurance company that will write insurance for skateboard rams at the present time. S) No food or beverages allowed inside the fenced area. 6) Extreme recklessness will not be tolerated. 7) No destroying or defacing public property. 8) Any infraction of the above rules will result in loss of skateboard card and all skating privileges . 9) Only three skaters on the platform at one time.
