AN ORDINANCE TO AMEND THE MUNICIPAL CODE OF THE
CITY OF AMES, IOWA, BY REPEALING SECTION 5.9 AND
SUBSECTION 5.21(10) THEREOF AND RE-ENACTING THE SAME
AND ENACTING NEW SUBSECTIONS 5.3(15) AND (16) FOR THE
PURPOSE OF PERMITTING LARGER HOUSING DEVELOPMENT
SIGNS ON A LIMITED BASIS; REPEALING ANY AND ALL
ORDINANCES IN CONFLICT AND ESTABLISHING AN EFFECTIVE
DATE; SETTING A PENALTY
BE IT ORDAINED, by the City Council of the City of Ames, Iowa:
Section One. The Municipal Code of the City of Ames, Iowa, shall be
and the same is hereby amended by enacting new subsections 5.3(15)
and (16) to read as follows:
"(15) Subdivision Development Sign: A temporary sign identify-
ing a new or developing residential housing subdivision
by name.
(16) Developer: The legal or beneficial owner or owners of
a lot or of any land included in a proposed development
including the holder of an option or contract to pur-
chase, or other persons having enforceable proprietary
interests in such land."
Section Two. The Municipal Code of the City of Ames, Iowa shall be
and the same is hereby further amended by repealing Section 5.9 as it
now exists and enacting a new Section 5.9 to read as follows:
"Sec. 5.9. PERMIT ISSUED IF APPLICATION IN ORDER.
It shall be the duty of the building official upon the
filing of an application for a permit to examine such plans and
specifications and other data and the premises upon which it
is proposed to erect the sign, and if it shall appear that the
provisions of the sign regulations and all other laws and
ordinances of the City of Ames are complied with, lie shall
then issue the permit. If the work authorized by such permit
Is not completed in six (6) months from the date of its
issuance, such permit shall become null and void.
In addition, where the permit is for a subdivision
development sign, the sign permit shall be renewed annually
until such time as the sign must be removed. Removal is
subject to approval by the City Building Official."
Section Three. The Municipal Code of the City of Ames, Iowa shall be
and the same is hereby further amended by repealing Subsection
5.21(10) as it now exists and enacting a new Subsection 5.21(10) to
read as follows:

"(10) Subdivision Development Signs. One subdivision
development sign may be permitted per preliminary plat
or Conceptual Development Plan for subdivisions of 2
acres or more in area. This sign shall not exceed 96
sq.ft. in area and 12 ft. in height. It shall be located
in the subdivision it identifies and no closer than 25 ft.
from any property line, no closer than 100' from any
pre-existing residence and only on lots abutting
collector or arterial streets. The sign shall be the sole
use of the property on which it is located. The sign
shall identify the name of the subdivision exactly as it
is set out on the preliminary plat or conceptual de-
velopment plan approved by the City and may include
the names of the subdivision developers, a map of the
area covered by the subdivision and a description of
amenities in it. The sign shall not be installed until
utility construction has begun in the subdivision and
the sign shall be removed once building permits have
been issued for 50% of the lots in the subdivision.
Section Four. Any and all ordinances or parts of ordinances
in conflict herewith are repealed to the extent of such conflict
if any.
Section Five. This ordinance shall be in full force and effect
from and after its passage and publication as required by
law.
Section Six. Violations of the provisions of this ordinance
shall constitute a municipal infraction punishable as set out
in Section 1.9 of the Ames Municipal Code.
