HomeMy WebLinkAboutA001 - Council Action Form dated April 25, 1989 a,C ITEM #: CAF DATE: 04/25/89 COUNCIL ACTION FORM SUBJECT: Motion to Set a Date of Public Hearing on Proposed Amendments to Section 29.49 (Site Plan Requirements) of the Zoning Ordinance. BACKGROUND: The Local Government Affairs Council of the Chamber of Commerce has identified a concern that developers have regarding staff review of devel- opment projects. Small development projects currently follow the same site plan review procedure as much larger development proposals. The Local Government Affairs Council would like to see the City adopt an abbreviated site plan review procedure for small development projects to address this concern. ANALYSIS: Current Procedure: Site plan approval is required for all new buildings or changes in the "footprint" or off-street parking of existing buildings located in a R-3, R-4, G-C, H-M, or C-C zoning district. Presently, applications for site plan approval are submitted to the Depart- ment of Planning and Housing. If the application is received no later than 9:00 a.m. , Tuesday, a meeting with the Development Review Committee (DRC) is set for Friday of that same week. On Friday, the DRC, com- posed of City staff members representing various City departments, review > the site plan and take-,one of the following actions: 1. Approve the site plan as presented; 2. Approve the site plan pending modifications; or, 3. Deny approval of the site plan. Upon approval, the petitioner may then apply for a building permit to begin construction. Development Review Committee (DRC): The DRC is composed of staff members for the following City departments: 1. Department of Planning and Housing; 2. Public Works Department; 3. Fire Department (Building Inspection Division); 4. Electric Department (Electric Engineering Division); and 2 5. Water and Pollution Control Department (Water Meter Shop Division) . These City staff members review site plans for compliance with the follow- ing: 1. Plat Requirements; 2. Zoning Use; 3. Zoning Area Requirements; 4. Parking Requirements; 5. Traffic Impact (Off-Site); 6. Site Engineering (On- and Off-Site) ; 7. Water, Sanitary Sewer, and Sump Pump Service; 8. Electric Utility Impacts; 9. Fire-Safety Impact; 10. Landscaping Requirements; and 11. Other Miscellaneous Requirements. Staff Response to Chamber Concern: One hundred-fifty square feet is the minimum amount of square feet in a building that requires an off-street parking space, according to off-street parking requirements specified by Section 29.40 of the Zoning Ordinance. If parking spaces are required for a building or an addition to a building, this will affect the rate of storm water runoff. If the rate of storm water runoff increases, this means the petitioner must submit a storm water management plan including grades and/or elevations, direction of surface flow, detention and retention areas, outlet control structures and devices, and storm water calculations supporting manage- ment design to the Public Works Department for approval. Therefore, the determination of whether a project must follow the approval procedure for a "minor site plan" for small projects or a "major site plan" for larger projects is based upon the following proposed definition of a "small project": A small project is proposed to be defined as a building or addition that: 1. Is smaller than 150 square feet; 2. Does not require additional parking space; and, 3. Does not increase the rate of storm water runoff. This would require an amendment to Section 29.49 (Site Plan Requirements) of the Zoning Ordinance (See Attachment #1) . Planning and Zoning Commission Recommendation: The Planning and Zoning Commission reviewed this request at their meeting of April 5, 1989, and recommended that it be approved. 3 ALTERNATIVES: 1. The City Council can approve of the proposed amendments to Section 29.49 (Site Plan Requirements) of the Zoning Ordinance, and set May 9, 1989, as the date of Public Hearing. 2. The City Council can deny approval of the proposed amendments to Section 29.49 (Site Plan Requirements) of the Zoning Ordinance, and set May 9, 1989, as the date of Public Hearing. 3. The City Council can refer this agenda item back to City staff for further study and additional information. MANAGER'S RECOMMENDED ACTION: It is the recommendation of the City Manager that the City Council adopt Alternative P. This will approve of the proposed amendments and set May 9, 1989, as the date of Public Hearing. COUNCIL ACTION:
