Dear Paul:
On behalf of my client, Terra Firma, L.P., I want to thank the city council and the city staff for
considering the issue of vacating and conveying three and a half-feet of the Chamberlain Street right-of-
way to the Terra Firma, L.P. Having considered the action of the city council to sell the property for over
$2,000.00 rather than to adopt the proposal of selling it for costs, my client has decided to withdraw the
purchase offer and to decline to pursue the proposal adopted by the city council.
I want to reiterate a couple of points I made to you in our telephone conversation following the
council meeting. My client is not at all interested in whether it has or the city has superior title to a couple
of feet of land that has been and will continue to serve as a driveway apron either way. This proposal was
intended as a gesture by a neighboring property owner in the process of preparing a subdivision plat of the
area. It was proposed by the client's engineer and attorney to clean up permanently the boundaries in the
area.
I trust that you will advise the city manager, city clerk, and city attorney that no additional action
on the proposal is required. Thank you again for the city's consideration of this issue. Please contact me if
you have any questions or concerns about this matter.
