COUNCIL ACTION FORM
SUBJECT: Ordinance to allow 19 and 20 year old people in certain
liquor license establishments.
BACKGROUND:
On June 1, 1989, City Ordinance 17.16(2)(d) came in effect. This
ordinance allowed persons aged 19 and 20 to be on the premises of
liquor license establishments where more than 500 of the business
conducted was for the sale and dispensing of alcoholic beverages. The
license establishments that wanted to participate had to submit a plan
for approval to the Chief of Police. This section was to be in effect
until December 31, 1989.
In early January 1990, the Council extended the "Sunset Clause" until
April 1, 1990. Attached you will find statistics from the police
department concerning alcohol violations within the participating
liquor license establishments, as well as from some other
establishments. Also attached is the original ordinance with the
April 1, 1990 "Sunset Clause," and a copy of a second ordinance which
has some changes included. The changes deal primarily with mandatory
signs at entrances to participating establishments and the plastic
wrist banding of both those 21 and over and the people 19 and 20 years
of age.
ALTERNATIVES:
1. Do not pass the ordinance and allow 17.16(2) (d) to expire
April 1, 1990.
2. Pass the original ordinance without the "Sunset Clause" of
April 1, 1990.
3. Pass a second ordinance which would allow 19 and 20 year old
people in those certain establishments, but would make some
changes in the rules to include mandatory signs and putting wrist
bands on all customers.
MANAGER'S RECOMMENDED ACTION:
It is the Manager's recommendation that the City Council adopt
alternative #1 and do not pass the ordinance. This would allow this
section of the ordinance to expire 4-1-90. The police statistics show
that the ordinance is very difficult to enforce and creates a
situation that appears to enhance alcoholic usage by those under 21
years of age.
COUNCIL ACTION:
