HomeMy WebLinkAbout~Master - Revising Beer Keg Party Regulations ORDINANCE NO. 3040 AN ORDINANCE TO AMEND THE MUNICIPAL CODE OF THE CITY OF AMES, IOWA, BY REPEALING SUBSECTION 17.27(1) AND ENACTING A NEW SUBSECTION 17.27(1) AND A NEW SUBSECTION 17.27(3)(D) FOR THE PURPOSE OF REVISING BEER KEG PARTY REGULATIONS; REPEALING ALL ORDI- NANCE OR PARTS OF ORDINANCE IN CONFLICT; PROVID- INGX A PENALTY AND ESTABLISHING AN EFFECTIVE DATE BE IT ',NACTED, by the city Council of the City of Ames, Iowa: Section One. The Municipal Code of the City of Ames, Iowa shall be and th� same is hereby amended by repealing subsection 17.27(1.) and enacting a new subsection 17.27(1) as follows: "(1) Permit Required. It is unlawful for any person other than a licensed beer permit holder on licensed premises to hold an event where more than one beer keg tapper is to be used at or about the same time without first ob- taining a permit from the Ames Chief of Police or the Chief's designee. A beer keg tapper is any apparatus used to draw or remove beer from a keg. Said permit may be obtained only by a natural person. Issuance of the permit will allow dispensing of beer from not more than two tappers concurrently. The permit shall not be issued to corporations, associations, or groups of peo- ple. Said permit must be obtained at least twenty-four hours before the event. Any person seeking such permit shall make an application, on such form as the Chief of Police may provide, stating: (a) The name and address of the applicant. (b) The name and address of the person, group, or- ganization or association sponsoring the event if different from the applicant. (c) The date and time and location of the event for which the permit is desired. (d) An estimate of the number of persons anticipated to attend the event. (e) Any other information which the Chief of Police shall reasonably find necessary to a fair and proper determination of whether the permit should be issued." Section Two. The Municipal Code of the City of Ames is further amended by adding thereto a new subsection 17.27(3)(d) as follows: "(d) Contact the police department after party preparations are made but before the beginning of the event to arrange for a pre-party inspection. A police department representative will visit the site and conduct an inspec- tion to verify conformance to the application." Section Three. Any and all ordinances or parts of ordinances in con- flict herewith are hereby repealed to the extent of such conflict, if any. Section Four. Violations of this ordinance shall constitute a municipal infraction punishable in accordance with Sec. 1.9 of the Ames Municipal Code. Section Five.
