HomeMy WebLinkAbout~Master - Revising Regulations Pertaining to Historic Preservation Districts a ORDINANCE NO. 3031 AN ORDINANCE TO AMEND THE MUNICIPAL CODE OF THE CITY OF AMES, IOWA, TO REVISE REGULATIONS PERTAIN- ING TO HISTORIC PRESERVATION DISTRICTS BY REPEAL- ING SUBSECTION 31.8(7) AND ENACTING A NEW SUBSEC- TION 31.8(7) ; ADDING A NEW SUBSECTION 31.8(8); RE- PEALING SUBSECTION 31.9 AND ENACTING A NEW SUBSEC- TION 31.9; REPEALING INCONSISTENT MEASURES; PROVID- ING A PENALTY; AND ESTABLISHING AN EFFECTIVE DATE. BE IT ENACTED by the City Council for the City of Ames, Iowa: Section One. The Municipal Code of the City of Ames, Iowa is amended by repealing subsection 31.8(7) thereof and enacting a new subsection 31.8(7) as follows: "(7) Provide information which indicates that 66 0 of the structures in the area are contributing and/or compatible." Section Two. The Municipal Code of the City of Ames, Iowa is amended by adding thereto a new subsection 31.8(8) as follows: "(8) Design guidelines proposed as an aid to decisions on Certificates of Appropriateness required by Section 31.10." Section Three. The Municipal Code of the City of Ames is amended by repealing Section 31.9 and enacting a new Section 31.9 as follows: "Sec. 31.9 PUBLIC HEARINGS AND ENACTMENT PROCE- DURES. (a) Oral and written testimony concerning the significance of the nominated historic district shall be taken at a public hearing before the Ames Historic Preservation Commis- sion. The Planning and Housing Department shall noti- fy, by certified mail, all property owners in a proposed district a minimum of twenty days prior to the public hearing to be held by the said Preservation Commission. The Preservation Commission upon hearing the proposal will review and make recommendations to the Planning and Zoning Commission. The Planning and Zoning Commission reviews and makes recommendations to the City Council. (b) The City Council forwards the proposed_ historic district designation to the State Historical Department for review and recommendation. Within a reasonable time after receipt of the recommendation from the State Historical Department the Council shall make a final determination on the proposed district designation. Designation of such an area shall be by enactment of an ordinance to amend the official zoning map of the City to show such designated area in accordance with the hearing, notice and procedure requirement of Chapter 414 Code of Iowa." Section Four. All ordinances or parts of ordinances in conflict herewith are repealed to the extent of such conflict. Section Five. Violation of this ordinance shall constitute a municipal infraction punishable pursuant to Section 1.9 of the Ames Municipal Code. Section Six.
