HomeMy WebLinkAbout~Master - Prohibiting Skateboards on Burnett Plaza ORDINANCE NO. 3014 AN ORDINANCE TO AMEND THE MUNICIPAL CODE OF THE CITY OF AMES, IOWA, BY REPEALING SEC. 17.28 AND ENACTING A NEW SECTION 17.28 FOR THE PURPOSE OF PROHIBITING SKATEBOARDS ON BURNETT PLAZA; ESTAB- LISHING A PENALTY FOR VIOLATIONS OF THIS SECTION; REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH; AND ESTABLISHING AN EFFEC- TIVE DATE. BE IT ENACTED by the City Council for the City of Ames, Iowa: Section One. The Municipal Code of the City of Ames, Iowa, shall be and is hereby amended by repealing Sec. 17.28 and enacting a new Sec. 17.28 as follows: "Sec. 17.28. SKATEBOARDS PROHIBITED IN CERTAIN LOCATIONS. The riding of or use of skateboards and similar devices is prohibited at the following locations: (1) on any sidewalk on Main Street from Duff Avenue to Clark Avenue, (2) in or on any part of Burnett Plaza." Section Two. Any person, corporation or other legal entity who violates or resists the enforcement of the requirements of this chapter shall be charged with a municipal infraction punishable by a civil penal- ty of ten (10) dollars for the first offense and fifty (50) dollars for any subsequent offense. Each day that a municipal infraction occurs constitutes a separate offense. Any person, corporation or other legal entity who violates this chapter after judgment has been entered for violating the same chapter provision at the same location or at a differ- ent location shall be charged with a repeat offense. Seeking a civil penalty as authorized in this section does not preclude the city from seeking alternative relief, including an order for abatement or injunc- tive relief. Section Two. All ordinances or parts of ordinances in conflict herewith are hereby repealed to the extent of such conflict, if any. Section Three. This ordinance shall be in full force and effect from and after its passage and publication as required by law. Adopted this 5 th day of July 1988.
