AN ORDINANCE TO AMEND THE MUNICIPAL CODE OF THE
CITY OF AMES, IOWA BY ADDING A NEW SUBSECTION
29.2(48) TO DEFINE "RESIDENTIAL CORRECTION FACILI-
TY"; REPEALING AND RE-ENACTING SUBSECTIONS
29.18(1), 29.19(1), 29.22(1), 29.23(1) AND 29.24(2)(a) TO
PROVIDE FOR SAID CORRECTIONS FACILITY AS A PERMIT-
TED USE IN THE PLANNED COMMERCIAL, CONCENTRATED
COMMERCIAL, GENERAL COMMERCIAL, AND HIGH DENSITY
RESIDENTIAL DISTRICTS, AND BY SPECIAL USE PERMIT IN
THE MEDIUM DENSITY RESIDENTIAL DISTRICT; REPEALING
ORDINANCES OR IN CONFLICT HEREWITH TO THE EXTENT
OF SUCH CONFLICT, IF ANY; AND, ESTABLISHING AN
EFFECTIVE DATE.
BE IT ORDAINED, by the City Council of the City of Ames, Iowa:
Section One. The Municipal Code of the City of Ames, Iowa, is hereby
amended by adding thereto a new subsection 29.2(48) as follows:
11(48) Residential Corrections Facili . A residential facility for
ty
adult offenders who are placed in the facility as a condition of
their probation, parole, work release, federal placement, or other
placement agreement. The facility must be accredited by the State
of Iowa Department of Corrections."
Section Two. Subsections 29.18(1), 29.19(1), 29.22(1), 29.23(1) and
29.24(2)(a) are hereby repealed and reenacted as follows:
"Sec. 29.18. R-3, MEDIUM DENSITY RESIDENTIAL DISTRICT
(1) Permitted Uses. A building or premises shall be used only for the
following purposes:
Single-family dwellings
Two-family dwellings
Multiple-family dwellings
Multiple-family dwellings that do not meet the R-3 regulations
which were lawfully constructed or under construction prior
to November 1, 1983, pursuant to zoning and building permits
as evidenced by the plans on file with the Chief Building
Official, in compliance with the applicable bulk regulations of
the R-4, High Density Residential District when the location
was zoned as R-4.
Boarding and lodging houses
Funeral homes and mortuaries
Nursing and convalescent homes
Places of worship
Private schools having curriculum similar to that offered by public
schools

Supervised Group Homes
Residential Corrections facility if allowed by a special use permit
pursuant to Sec. 29.45 and its standards, provided further
that it not be nearer than 500 feet to another such facility or
a supervised group home.
Sec. 29.19. R-4, HIGH-DENSITY RESIDENTIAL DISTRICT.
(1) Permitted Uses. A building or premises shall be used only for the
following purposes:
Single-family dwellings
Two-family dwellings
Multiple-family dwellings
Boarding and lodging houses
Sororities and Fraternities
Funeral homes and mortuaries
Nursing and convalescent homes
Places of worship
Private schools having curriculum similar to that offered by public
schools
Retirement and homes for the elderly
Supervised Group Homes
Residential Corrections Facility, if not nearer than 500 feet to
another such facility or supervised group home.
Sec. 29.22. G-C, GENERAL COMMERCIAL DISTRICT
(1) All uses involving retailing, commercial services, and products to
the general public, wholesaling, warehousing, and residential
corrections facilities, located no closer than 500 feet to another
residential corrections facility or a supervised group home. It is
also intended to accommodate, in those same areas, the develop-
ment of mixed land uses which will allow the combination of com-
mercial and residential uses in the same structure. Residential
uses should be located above the first floor, however, the first
floor may be occupied by residential uses in residential corrections
facilities.
Sec. 29.23. C-C, CONCENTRATED COMMERCIAL DISTRICT
(1) All uses involving retailing, commercial services, and products to
the general public, wholesaling and warehousing in connection with
retail and service business, and residential corrections facilities,
located no closer than 500 feet to another residential corrections
facility or a supervised group home. Residential uses should be
located above the first floor, however, the first floor may be
occupied by residential uses in residential corrections facilities.

Sec. 29.24. P-C, PLANNED COMMERCIAL
(2) Use regulations. The following regulations and procedures shall
apply to the uses made of land in a P-C District.
Apothecary shop
Barbershop
Beauty shop
Business office
Dwelling
Gasoline service station
Grocery, fruit or vegetable store
Hotel/motel
Professional office
Restaurant
Retail store (for specific and general merchandise)
Studio--photography, artist, dance or musician
Other similar retail and service establishments.
Residential Corrections Facility if not nearer than 500 feet to
another residential corrections facility or a supervised group
home."
Section Three. All ordinance or parts of ordinances in conflict here-
with are hereby repealed to the extent of such conflict, if any.
Section Four. This ordinance shall be in full force and effect from and
after its passage and publication as required by law.
