In Re: Adoption of "Municipal Infraction" System for Code Enforcement
Dear Mayor Goodland and Council Members:
Section 364.22, Code of Iowa, 1987, is a new law that holds promise for
more efficient and effective city code enforcement. The violation is
decriminalized, but an "abatement" remedy is combined with the civil
penalty, the amount of the potential fine is increased, and there is
clear provisions for each day of the continuance of the violation to be
a separate offense.
Attached you will find for your review the following:
1. Proposed ordinance adopting the municipal infraction procedure and
designating violations as simple misdemeanors or municipal infrac-
tions.
2. A list of ordinance violations. The list reflects the delineation
of all code violations into two categories. These lists were
prepared for easy reference to determine the category for each
ordinance violation if the above ordinance were adopted.
3. Proposed forms to be used in the municipal infraction process.
The determination as to which code sections should be classified as
municipal infractions and which should be classified as simple misde-
meanors was made according to the following guidelines:
1. Chapter 364.22, Code of Iowa, provides that all violations which
are felonies, aggravated or serious misdemeanors or simple misde-
meanors under chapters 687 through 747, cannot be a municipal
infraction. Thus any municipal code violation which is codified by
adoption of chapters 687-747 (criminal code) or is otherwise
similar to a violation found in those chapters will continue to be
punishable as a simple misdemeanor.
AMES—THE CENTER OF IT ALL
2. A violation will continue to be a misdemeanor if it is a violation
of the state code in some chapter other than those named above.
For example, Section 321.482 requires that motor vehicle traffic
violations be misdemeanors.
3. Violations will continue to be misdemeanors if it is of such a
nature that it is a crime against persons or property.
In the following paragraphs the substance of the proposed changes is
explained.
Section 1.6, the penalty section has been revised to establish two types
of violations -- simple misdemeanors or municipal infractions. A
violation is a simple misdemeanor if it specifically states in the Code
that it is a simple misdemeanor. All violations not so identified will
be municipal infractions.
A new section 1. 9 establishes the procedure for enforcement of municipal
infractions. You will note a schedule of penalties for municipal infrac-
tions. That is a $30/$100/$200 progressive fine based on the number of
offenses. Des Moines has established a $100 fine for the first offense
and $200 fine for a subsequent offense for zoning violations. Story
County uses a $50/100/200 progressive fine schedule for zoning viola-
tions. Iowa City uses the schedule I have proposed for all violations.
The City would have the option of adopting different penalties for
different code violations. The advantage of such a schedule is that the
penalty could be more appropriate for the violation. The flexibility of
the fines imposed for simple misdemeanors is lacking when a scheduled
fine is used. However without a scheduled fine, a court appearance will
be required for every violator. In my opinion that is undesirable and
unnecessary for some violations such as animal violations.
If a variety of penalties were adopted, it may be quite confusing to the
enforcement official . You will note that I have not provided an option
that if the violation is abated the penalty does not have to be paid.
Des Moines does have such an option on zoning violations. Obviously
that is an incentive to the defendant to abate the violation. However,
the procedure clearly allows the enforcement officer to request that the
defendant correct the violation if appropriate, and also to impose a
fine. It is my belief that if a violation has occurred, the defendant
should have to pay a penalty. Otherwise there is very little incentive
to correct the violation until the citation is issued. The court costs
of $13. 00 will have to be paid in any event. If the court believes that
a fine should not be imposed, the options of a deferred judgment of
suspended sentence are available.
You will note that a third and subsequent offense can be punished by a
fine of up to $200 which is more than the $100 fine for a simple misde-
meanor. Some inequity may appear. However, it should be kept in mind
that persons found guilty of simple misdemeanors always face the possi-
bility of a jail sentence.
Each section of the municipal code was reviewed. Some sections in the
current code provide for a penalty within that section. Other sections
merely state the offense and do not provide for a penalty and instead
rely on the general penalty section found in Sec. 1.6. For those
sections in which it was expressly stated that the offense was a simple
misdemeanor, that wording remains if the offense is to continue as a
simple misdemeanor. If the offense is to become a municipal infraction,
that section was reworded to omit the reference to simple misdemeanor or
to reflect that the offense is a municipal infraction.
Substantial changes appear in the following sections of the proposed
ordinance.
Thirteen 17. 1(9) Fraudulent Adopts the same violation found

Every chapter of the code has been reviewed and revised, if necessary,
with the exception of Chapters 5 (Building), 7 (Electrical ), 8 (Fire),
and 21 (Plumbing). Each of these chapters is still in the process of
being reviewed by administrative staff. The appropriate reference to
municipal infractions is included in draft ordinance revisions pertain-
ing to those chapters.
Also enclosed are copies of documents to be used in the municipal
infraction process. These were prepared in consultation with the Clerk
of Court' s office.

PROCEDURE FOR ISSUING MUNICIPAL INFRACTIONS CITATIONS
1. The enforcement officer or peace officer shall use the standard
citation form for all municipal infractions.
2. The officer will issue the citation personally.
A. The officer will request the Defendant to sign the citation
accepting service. However, if the Defendant fails to sign
the officer cannot force him to sign.
B. If Defendant refuses to sign, then the officer must fill out a
proof of service which must be filed with the court at the
time the citation is filed.
C. If Defendant refuses to accept the citation, it will be served
by certified mail , return receipt requested.
3. The citation will be filed with the Clerk of Court.
4. There will be a schedule of penalties which is uniform for each
offense. That schedule of fines appears on the citation and the
appropriate penalty should be marked by the officer.
5. The Defendant will be ordered to pay the penalty and court costs
and may be ordered to correct the violation.
6. If the Defendant wishes to pay the penalty and court costs and
correct the violation in the required time, he may do so by paying
the penalty and court costs and submitting proof of compliance, if
necessary, along with a signed copy of the citation. They do not
need to appear. Essentially these will be handled like scheduled
traffic violations.
7. If the Defendant denies the charge, he must appear in court at a
specified time. A trial date will be set.
8. If a Defendant is ordered to correct the violation, he must submit
signed proof of compliance to the Clerk by the date ordered.

INTRODUCTION
The municipal infraction procedure is a law recently enacted by the
Iowa Legislature which provides another tool to municipal officials to
enforce local codes. The enabling legislation is found at Section
364.22, Code of Iowa, 1987 as amended.
On February 23, 1988, the Ames City Council adopted an ordinance
which designated certain municipal code violations as municipal infrac-
tions. Up until this time, all municipal code violations were criminal
simple misdemeanors.
The purpose of this training manual is to explain the actual
process of issuing a citation for a municipal infraction. Remember that
the infraction procedure is only the last step in your efforts to
enforce the code. It does not and should not replace your efforts at
obtaining voluntary compliance.
The municipal infraction procedure holds promise for more efficient
and effective code enforcement. However, the effectiveness of any code
enforcement program is dependent upon the individual enforcement person-
nel . There are certain standards professional standards to which all
enforcement officials should adhere. They include:
1. Know and understand the code. Be able to explain to the public
what is required.
2. Enforce the code fairly and consistently.
3. Identify yourself. Always carry a city photo ID card and show it
to any person requesting identification. Your Department head may
obtain one of these ID cards for you through the Personnel Depart-
ment for a minimal fee.
4. Be courteous and try to gain cooperation.
5. Remember that many people are not familiar with code requirements
and court procedures. Answer all questions clearly and correctly.
Significant features of the municipal infraction program include:
1. A municipal infraction is a civil , rather than a criminal , viola-
tion of the Ames Municipal Code.
2. Municipal infractions are a process by which authorized enforcement
officials can issue citations when there is reason to believe a
municipal code section has been violated.
3. A penalty must be paid if a violation is admitted or found by the
court.
4. There is a provision for ordering compliance with the code.
5. There are progressively higher penalties for subsequent offenses.

6. Each day a violation occurs or is permitted to exist may be charged
as a separate violation.
7. The burden of proof is upon the City to prove that a violation oc-
curred. The proof must be by clear, satisfactory and convincing
evidence.
8. No individual can be arrested for committing a municipal infrac-
tion.
9. The court cannot impose a jail sentence as a penalty.
10. Constitutional safeguards for criminal defendants and criminal
procedures are not applicable. These include.

b. Fifth amendment rights against self-incrimination

PROCEDURES
A. ISSUING A CITATION
1. The enforcement official determines that a violation has
occurred that has not been or cannot be resolved through
letters, personal contact, etc. All code required notices
have been given and procedures followed.
2. Determine the appropriate person to cite. This will be the
person, partnership, or corporation committing the offense.
Your records should contain information on how this person was
identified as the person to cite.
3. A citation for a municipal infraction shall not be issued to a
juvenile except as directed by the City Attorney' s office.
4. A citation usually will be issued at the time the offense is
discovered. If possible, the citation should be issued at the
time of the inspection. A citation may be issued only by an
enforcement official who has witnessed the violation or who
has personal knowledge of the violation.
5. Complete the citation. Samples of completed citations may be
found on pages 14-19. You should attempt to complete all the
lines except for the Case Number which is filled in by the
Clerk of Court. You may obtain the necessary information by
asking the defendant for it. At a minimum you must get their
full , correct name and correct address. Social security
number, date of birth, etc. are optional but preferable for
the court records. Fill in the number of the municipal code
section that was violated, and the date, time, location and
the name of the offense. A brief statement of what actually
happened must be completed. This should be particularly
detailed so that the Defendant understands what the violation
is.
6. Check whether the violation is a scheduled offense or an
offense which has another penalty amount. (The majority of
the offenses are the standard penalty. )
7. Fill in the penalty amount. (same as that checked in the box
above) Add that amount to the court costs of $14. 50 plus any
additional certified mail fees to determine the total amount
to be paid. Everyone must pay a penalty. If you order the
violation to be corrected, check the appropriate box.
8. Fill in the date by which the penalty must be paid and compli-
ance must be accomplished. This should always be a Monday.
You have been provided a copy of the dates of all Mondays in
1988. (See Page 13) A general rule of thumb for determining
the appearance date would be the second Monday after the date
the citation is issued. Additional time should be allowed if
you determine compliance will take longer or to allow time for
certified mail delivery.

9. The same date should be filled in for the court date at which
the defendant must appear if he wishes to deny the charge.
10. Sign citation and include your address, telephone number and
date.
B. SERVICE OF CITATION
Correct service of the citation is essential because the court will
not consider imposition of a judgment, penalty and order to comply until
there is evidence of correct service. If the court does not have the
original citation plus proof of service, the case will be dismissed and
your department will be billed $13.00. The judge may question the
Defendant about whether he has received the citation.
1. Request that the person to whom you are giving the citation
sign and date the citation in the area marked "Acceptance of
Service. Their signature only indicates that they have
received the citation. They are not admitting that they have
done anything wrong. Encourage them to sign by explaining to
them that they are not admitting that they did anything wrong,
but are only acknowledging service of the citation.
2. When no one will sign, but will accept the citation, you must
complete the proof of service as explained in "3" below. The
citation will be reviewed and then filed with the Clerk of
Court by the attorney.
3. If the Defendant does not sign the citation, you will need to
complete the proof of service located on the bottom of the
citation. Your signature must be notarized. Employees in the
office of the City Attorney and Clerk of Court are notary
publics and will be able to notarize your signature at no
cost.
4. If you cannot locate the defendant to serve the citation you
may obtain personal service in one of the following ways.
a. on any individual , at least 18 years old, at the defen-
dant' s residence.
b. on the defendant' s spouse at a place other than the
residence if there is probable cause to believe the
spouse lives at defendant' s residence.
5. There are special rules for serving a corporation or partner-
ship. Contact the City Attorney' s office if you need to do
so.
When no one will accept service, or a Defendant lives out of town,
service may be obtained by certified mail , return receipt request-
ed.
1. The defendant' s two copies (pink and goldenrod) must be sent
certified mail , return receipt requested. The enforcement
official is responsible for the mailing. Prior to mailing be

sure the mailing fee is written down on the citation as an
additional fee to be paid by Defendant. The standard fee for
certified mail , return receipt, is $1.67.
2. Be sure you schedule an appearance date sufficiently in the
future to allow for mail delivery and return of the receipt.
3. File the white and green copies of the citation with the City
Attorney' s office on the date you mail Defendant' s citation.
The white mailing receipt should be attached. (Sample on page
20)
4. When the green card is returned, forward it to the City
Attorney' s office for attachment to the court file. (Sample
on Page 20)
C. DISTRIBUTION
1. The pink and goldenrod copies must be given to the defendant
whether you personally serve them or serve them by mail .
2. Keep the canary copy for your records.
3. Take the white and green copies to the City Attorney' s office
and leave them if the acceptance of service is signed by the
defendant. The citations you issue should be turned in on a
daily basis.
4. If the citation was not signed by the defendant, you will need
to complete the acceptance of service located on the bottom of
the citation. Your signature must be notarized. There is a
notary in the City Attorney' s office or in the Clerk of
Court' s office and either will be able to notarize your
signature at no cost. If you have a notary in your office
they may notarize your signature also. However, the citation
must still be brought to the City Attorney' s office for review
prior to filing.
D. PROOF OF COMPLIANCE
1. In some instances, the code violation may need to be correct-
ed.
2. You may order the violation corrected by checking the appro-
priate box on the citation form
3. Additionally, you must complete the Proof of Compliance form
except for the signature line. Samples of Proof of Compliance
forms are found on pages 17 and 19.
4. The Proof of Compliance should be specific enough so that the
Defendant understands what is expected.
5. Give the Defendant the pink and goldenrod copies at the time
you serve the citation.
6. Keep the canary copy for your records.

7. Take the white copy, along with the citation, to the City
Attorney' s office for filing.
8. The defendant must arrange with you to reinspect for compli-
ance and arrange for your signature.
9. Be sure to make a notation on your file copy of the date you
sign a proof of compliance form.
10. The pink, signed proof of compliance must be filed with the
Clerk of Court by the appearance date. That is the Defen-
dant' s responsibility.
E. ADMITTING/DENYING INFRACTIONS
1. Admitting to an Infraction
a. A Defendant may admit the violation by paying the penalty
and court costs no later than the date indicated on the
citation. The Defendant must submit the total payment
plus the pink, signed copy of the citation.
b. Payment is made to the Clerk of Court, Fifth and Kellogg,
Ames. Payment can be made by check, if mailed in but if
they pay over the counter they must pay in cash.
2. Denying an Infraction
a. To deny, the Defendant must appear at the time and date
set on the citation. The purpose of the appearance is to
enter the plea and set a trial date. The Judge will not
at that time listen to the Defendant' s explanation of
what happened. The enforcement official does not need to
be at the appearance.
F. TRIALS
1. The City Attorney' s office will notify you of a trial date.
You will be the primary witness. If there are other witness-
es, please let the City Attorney' s office know immediately.
2. When any citation is issued, as preparation for a possible
trial , the enforcement official should have, at the time of
issuing the citation:
a. Taken photos of the violation when necessary. If there
appears to be any possibility of misinterpretation, a
photo is strongly recommended.
b. Taken measurements when necessary.
C. Made notes of important facts and dates which may be used
to refresh your memory at the time of trial .
3. Remember, if the case goes to trial , the burden is on the city
to prove that the violation occurred. That can only be done

by presenting facts through testimony, photos or other exhib-
its.

Court - District Associate Court, located at Fifth and Kellogg, second

Courtroom - Where all trials are held and where Defendants must appear
if they wish to deny the infraction. It is located at 5th and Kellogg,
Second floor.
Defendant - The person to whom you issue the citation
Enforcement Officer - Any City of Ames employee designated to enforce
the municipal code.
Judge - District Associate Judge. They are Hon. Thomas Hronek and Hon.
Steven Van Marel .
Juvenile - Any individual less than 18 years of age.

TROUBLESHOOTING GUIDE
QUESTION 1: HOW DO I KNOW IF A VIOLATION IS A MUNICIPAL INFRACTION?
ANSWER: You or your department will be given a compendium of all
ordinance violations which are municipal infractions. If it is not
listed in the compendium, it is not a municipal infraction.
QUESTION 2: HOW DO I KNOW HOW MUCH THE PENALTY IS?
ANSWER: Most violations have a standard penalty of $30 for the first
offense, $100 for second offense, and $200 for third and subsequent
offenses. All violations that have the standard penalty, appear in the
compendium as "standard". If the penalty is different than the standard
amount, it is listed in the compendium.
QUESTION 3: WHAT IS A SECOND OR SUBSEQUENT OFFENSE?
ANSWER: A second or subsequent offense may be filed when the person has
admitted or been found by the court to have committed the offense. The
violation must be for the same code section, by the same person. It can
occur at a different address or location.
QUESTION 4: HOW DO I KNOW IF THIS IS A SECOND OR SUBSEQUENT VIOLATION?
ANSWER: The department should maintain records of how many offenses
occurred. Departments will receive reports on disposition of filed
cases from the City Attorney' s office.
QUESTION 5: DO I HAVE TO CHARGE A SECOND/SUBSEQUENT VIOLATION?
ANSWER: No. Enforcement should be carried out according to departmen-
tal policy. The enforcement official will decide whether to cite a
person for second and subsequent violations.
QUESTION 6: WHAT HAPPENS IF I FAIL TO CORRECTLY FILL OUT THE CITATION?
ANSWER: All citations will be reviewed by the City Attorney' s office
before filing them with the Clerk of Court. Citations can be amended to
make them correct by filing a written amendment with the court. It
does, however, increase the court costs every time a written order is
done by the court, so it will be to everyone' s benefit if the enforce-
ment officer fills out the citations carefully. If you know there is an
error on the citation, let the City Attorney' s office know immediately
so an amendment can be done. DO NOT simply correct it on the remaining
copies after the Defendant has been given his copies.
QUESTION 7: WHAT IF SOMEONE WANTS TO ADMIT THE VIOLATION BUT CANNOT PAY
THE PENALTY BY THE DUE DATE?
ANSWER: They should appear in court at the scheduled time and request
additional time from the court.

QUESTION 8: WHO SIGNS THE PROOF OF COMPLIANCE?
ANSWER: The issuing enforcement officer should sign the proof of
compliance. If, due to vacation schedules or other long-term absences,
the issuing enforcement officer cannot sign, another enforcement offi-
cial , knowledgeable of the violation and correction required may sign
the proof of compliance after making an inspection.
QUESTION 9: CAN I FILE A SEPARATE CITATION FOR EACH DAY A VIOLATION
EXISTS?
ANSWER: Yes.
QUESTION 10: WHAT IF THE DEFENDANT SAYS THEY CAN'T APPEAR ON THE
SCHEDULED DATE FOR A COURT APPEARANCE?
ANSWER: 1) Remind them they do not need to appear if they intend to
pay the penalty and comply.
2) If they do wish to appear and you have access to all the
copies, the date may be changed to another Monday at that
time.
3) The Defendant may contact the court at 239-5139 to request
another appearance date.
QUESTION 11: WHAT IF THE DEFENDANT NEEDS ADDITIONAL TIME TO CORRECT A
VIOLATION?
ANSWER: The defendant must contact the court to obtain additional time.
QUESTION 12: WHAT IF THE DEFENDANT REFUSES TO SIGN THE CITATION?
ANSWER: 1) Explain that he is not admitting that he did anything
wrong by signing.
2) Ask if he will accept the citation without signing it. If
yes, leave defendant' s copies and fill out the proof of
service at the bottom.
QUESTION 13: CAN A DEFENDANT BE ARRESTED FOR A VIOLATION?
ANSWER: No.
QUESTION 14: WHAT HAPPENS IF A DEFENDANT REFUSES TO COOPERATE OR ACTS
IN A HOSTILE OR THREATENING MANNER?
ANSWER: Leave the premises and serve the citation, if necessary by
certified mail , return receipt. If a person refuses the order of a
police officer, they may be cited for Interference with Official Acts, a
simple misdemeanor.
