Dear Dale: This is to confirm our telephone conversation of this afternoon in which you advised that there will be a "very substantial" claim for damages made in connection with the vacating of a portion of Airport Road. As to your query on whether the City followed the procedure of Chapter 306, the City followed the procedure of Chapter 364 in reliance on the September 13, 1977 opinion of the Attorney General that Chapter 364 procedures on vacating take precedence over the Sec. 306 procedures by virtue of Sec. 4. 7 providing that the more specific provisions take precedence over the general . You are correct in noting that there has been no court decision on that issue. It is hoped that the claimants will state the amount of their claim at their earliest convenience so that this can be factored into the finan- cial planning for the Park. Under the terms of the agreement between the City and the State for development of the ISU Research Park, the ISU Research Foundation will reimburse the City for the amount the City is obligated to pay as damages.
