SUBJECT: Resolution Proposing to Vacate a Portion of Airport Road and
Setting a Date of Public Hearing to Consider the Conveyance of a
Portion of Airport Road.
BACKGROUND:
As part of the development of the ISU Research Park, it is necessary that the
City vacate approximately 560 feet of the existing Airport Road right=nf=way.
This is necessary to allow for the development of the two lots that are being
proposed as part of Phase I of the Research Park.
The portion of the existing road right-of-way to be vacated is generally
located west of the east right-of-way line of the old Chicago and North
Western railroad right-of-way and east of the easterly most property line of
the private property associated with the Country Store located along Elwood
Drive. No portion of the Airport Road right-of-way adjacent to the Country
Store property will be vacated. This will remain so as to maintain public
street access to these properties.
In that the City currently has a water main and overhead electrical facilities
in this right-of-way, it will be necessary to maintain easements for these
facilities plus other private utilities.
In that it is necessary for the City to receive consideration for property
that the City disposes of, it is proposed that Iowa State University dedicate
right-of-way to the City as part of the realigned Airport Road plus the looped
road that is part of Phase I of the Research Park. Because of this ; the
Council should not give final approval to the ordinance to vacate and to the
resolution to convey right-of-way until after the Final Plat is approved.
A copy of the appropriate legal notices, resolutions, and ordinances are
attached for your review. In addition, a copy of the Conceptual Development
Plan showing a portion of the right-of-way to be vacated is also attached for
your review.
Staff is recommending that this portion of Airport Road be vacated.
ALTERNATIVES:
1. The City Council can approve the concept that a portion .of Airport Road be-
vacated to allow for the development of the-Research -Park and -set August-4
as the date of Public Hearing to consider. the ordinance -to- vacate th-at
portion of Airport Road. The Council can also adopt a resolution- proposing
the conveyance- of the vacated portion of Airport Road:.and 'set August 4 as.
the date of hearing on the proposed conveyance.

2. The City Council can decide not to vacate that portion of Airport Road which
is necessary for the development of Phase I of the ISU Research Park.
MANAGER'S RECOMMENDED ACTION:
It is the recommendation of the City Manager that the City Council adopt
Alternative #1. This will approve the vacating of the portion of Airport Rod
necessary to allow for the development of Phase I of the Research Park and set
August 4 as the date of Public Hearing to consider the ordinance and resolution
to vacate and convey the right-of-way of Airport Road. M z
The final enactment of the ordinance to vacate the right-of-way and the
resolution conveying our interest in the right-of-way should not occur until the
City Council approves the Final Plat of Phase I of the Research Park.

AN ORDINANCE TO VACATE A PORTION OF AIRPORT ROAD
LOCATED IN THE CITY OF AMES, IOWA.
BE IT ORDAINED BY THE CITY COUNCIL FOR THE CITY OF AMES. IOWA:
Section 1. That the Part of Airport Road described as:
Beginning at a point on the south right of way line of Airport
Road 396 feet east of the northwest corner of the SW1/4 of
Section 15, T83N, R24W of the 5th P.M. Story County, Iowa,
thence east along said right of way 1,063. 1 ft. to the west
right of way line of the former C & NW railway; thence south-
easterly 100 feet to the east right of way line of said C & NW
railway; thence northeasterly along east right of way line of
said C & NW railway 89.4 feet to the north right of way line
of Airport Road; thence northwesterly 100 feet to the west
right of way line of said C & NW railway; thence west along
north right of way line of Airport Road parallel to and 80
feet distant from south right of way line of Airport Road a
distance of 562. 4 feet; thence north 7. 0 feet; thence north-
westerly 564. 24 feet; thence south 120.97 feet to the point of
beginning
and the same is hereby vacated.
Section 2. All ordinances or parts of ordinances in conflict
herewith are hereby repealed to the extent of such conflict.
Section 3. This ordinance shall be in full force and effect from
and after its passage and publication as required by law.

certain land constituting the vacated part of Airport Road in Ames, Iowa
be conveyed by quit claim deed to the Iowa State Achievement Foundation
for and in consideration of a conveyance to the City of Ames of the land
needed for the ISU Research Park, and the Granting of an easement for
utility purposes.
You are further notified that a hearing on said proposed conveyance
will be held in conjunction with the regular meeting of the City Council
of the City of Ames, Iowa scheduled to begin at 7:30 p.m. August 4,
1987, in the City Council Chambers located in the Administration Build-
ing at the corner of Main and Pearle Streets in the City of Ames, Iowa.
Any and all persons desiring to be heard for or against the proposed
conveyance as aforesaid may then appear and be heard.

RESOLUTION PROPOSING THE SALE AND CONVEYANCE BY THE CITY OF
AMES OF SUCH RIGHT, TITLE AND INTEREST AS THE CITY OF AMES
SHALL HAVE IN CERTAIN LAND CONSTITUTING THE VACATED PORTION OF
AIRPORT ROAD IN THE CITY OF AMES, IOWA; SETTING DATE, TIME AND
PLACE OF PUBLIC HEARING THEREON AND DIRECTING PUBLICATION OF

BE IT RESOLVED by the City Council for the City of Ames, Iowa:

University Achievement Foundation for and in consideration of the
conveyance to the City of Ames, Iowa of the land needed for the street
