HomeMy WebLinkAboutA002 - Council Action form dated August 18, 1987 ITEM#: DATE. 8 8 COUNCIL ACTION FORM SUBJECT: Motion to Set Date of Public Hearing to Consider the Rezoning Request of 2325 Timberland Road BACKGROUND: Mike and Jo Ann Durlam have requested that their property at 2325 Timberland Road be annexed to the City. Section 29.4 requires that all property annexed to the City be rezoned so as to be consistent with the Land Use Policy Plan and zoning in the City. The property in question is currently zoned A-1 (Agricultural ) in Story' County. The applicants have requested that their property be zoned R1-10 (Low Density Residential ) . The surrounding property is zoned as follows: North: Vacant lot; A-1 (County) South: Residential ; S-R (City) East: Residential ; S-R (City) West: Residential ; S-R (City) The applicants have requested the R1-10 zoning because the property in question contains 17,874 square feet and the minimum lot size required by the S-R (Suburban Residential ) zoning district is 20,000 square feet. The Planning and Zoning Commission discussed this issue at length and concluded that the S-R zoning designation is the appropriate zoning designation. This will create consistency with respect to the zoning of other parcels in the area as well as consistency with the Land Use Policy Plan. The Planning and Zoning Commission has reviewed this request and has recommended that it be rezoned to S-R. A copy of a map showing the parcel to be rezoned is attached for your review. ALTERNATIVES: 1. The City Council can approve of the request to rezone the property at 2325 Timberland Road and set September 1, 1987, as the date of Public Hearing to consider the request. 2. The City Council can deny approval of the request to rezone the property at 2325 Timberland Road. 3. The City Council can refer the request back to the Planning and Zoning Commission for further review and comment. 2 MANAGER'S RECOMMENDED ACTION: It is the recommendation of the City Manager that the City Council adopt Alter- native #1. This will set September 1, 1987, as the date of public hearing to consider rezoning of 2325 Timberland Road from A-1 (County) to S-R (City) . A map, drawn to scale, showing the area affected by the pro- posed rezoning and at least 200 feet surrounding the proposed rezoning area. This map must clearly delineate the bound- aries of the area to be rezoned. The map shall show the names and addresses of the property owners of each lot in the affected area as well as the names of the property owners of each parcel within 200 feet of the affected area. 3. If the map noted above is larger than 11"x17" , the appli- cant(s) shall submit a blackline reduction of said map which is 11"x17" or smaller. No blueline maps will be accepted. 4. A map prepared by the Department of Planning and Housing show- ing the 200-foot boundary around the proposed rezoning area and a list of names and addresses of the property owners within 200 feet.
