AN ORDINANCE TO AMEND THE MUNICIPAL CODE OF THE CITY
OF AMES, IOWA BY REVISING SUB-SECTION 28. 78(1) AND
SECTION 28.80 THEREOF TO SUBSTITUTE WORDS "THE
EMPLOYEES" WHERE PRONOUN "HIS" WAS OMITTED IN 1980
CODIFICATION OF AMES CITY ORDINANCES.
WHEREAS, the word "his" was omitted from sub-sec. 28. 78(1) and Sec.
28.80 of the Ames Municipal Code of 1980 as part of a general policy of
discontinuing the use of gender specific pronouns when alternative
wording was possible; and,
WHEREAS, through inadvertence, without intending to change the meaning
of the code sections, no alternative wording was substituted for the
omission of "his" from the aforesaid sections,
NOW, THEREFORE, BE IT RESOLVED, by the city council for the city of
Ames, Iowa:
Section One. The Municipal Code of the City of Ames , Iowa shall be and
the same is hereby amended by repealing sub-section 28. 78(1) and Sec.
28.80 and enacting a new sub-section 28. 78(1) and Sec. 28.80 as follows:
"Sec.28. 78. AMOUNT OF DEATH BENEFIT.
The amount of death benefit shall be as follows:
(1) Upon the death of an employee in service an amount equal
to the sum of the employees accumulated contribution and
regular interest accumulated thereon.
"Sec.28.80. ACCUMULATED CONTRIBUTIONS, WHEN PAYABLE.
Upon termination of employment by resignation or dismissal the
employee shall be paid the amount of the employees accumulated
contributions, except that any such employee may elect not to
withdraw such accumulated contributions as were made prior to
February 1, 1964.
Payment shall be made in a single cash sum as soon as practi-
cable after receipt by the director of finance of a written
notice from the employees administrative officer that the
employee has been separated from employment.
Section Two. All ordinances or parts of ordinances in conflict herewith
are hereby repealed to the extent of such conflict if any.
Section Three. This ordinance shall be in full force and effect from
and after its passage and publication as required by law.
