COUNCIL ACTION FORM
SUBJECT: Proposed Transient Merchants Ordinance
BACKGROUND:
Currently there are no requirements for Transient Merchants to be licensed in
Ames . The City Clerk ' s office has requested ( for several years ) that
individuals complete an information form to provide assistance to our office and
the Police Department in answering citizen questions. This process, while
providing some information, is entirely voluntary. Interest has been expressed
(from the business community and the Police Department) in obtaining a better
control over peddlers coming into Ames and the question was referred to staff by
Council Member Parks . This desire has resulted in several meetings and the
attached proposed ordinance . The information to be obtained will give
assistance to the Police Department in the event of a problem occurring during
the time or after a group is in Ames selling merchandise. City staff will also
have better information to answer questions from citizens . Hopefully, the
ordinance will provide increased protection for Ames residents.
Individuals selling in Ames will be informed that there is a lq Local Option
Sales Tax to be collected. Those individuals will be required to provide proof
of their Iowa Sales Tax Permits. This will provide a measure of assurance that
all businesses operating in Ames do so under the same regulations - i .e. tax
requirements, etc.
The process proposed will be a simple one:
a) The individual will complete an application form in the City
Clerk ' s office. Each individual selling for a company is
required to be licensed. (See attached form. )
b) The individual will carry a copy of the application form to
the Police Department. The Police Department will develop a
file on the individual and take two Polaroid pictures - one to
retain in their file and one to be returned to the City
Clerk' s office to be laminated onto the license.
c) The City Clerk ' s office will complete the license, affix the
picture and laminate the license. The license and a badge
(holder) will be given to the individual .
The pictures retained in the Police Department will provide identification
assistance to the Department in the event of a complaint. The picture laminated
on the badge will assure ( hopefully) that the badges are not passed from one
person to another and that the badges are not altered in any way. The badges
will state that the City of Ames in no way endorses the products sold by the
licensee. If a complaint is received from a citizen and the citizen states that
the individual is not wearing a badge, the Police will be able to immediately
stop the individual from selling in Ames until a permit is received. If the
individual is wearing a badge, the Police Department will be able to use the
photographs in their files to have the complainant identify the individual about
whom the complaint is made.
Equipment required : One laminating machine and start-up supplies ($400-$450) .
Funds for the machine will be obtained from the City Clerk' s operating budget.
City Manager approval of the expenditure will be given if the Council approves
this concept.
Fee for the license : Staff is proposing a $16 fee per license. This proposed
fee includes the cost of the laminating machine, supplies for the machine,
Police Department and City Clerk personnel costs, film costs, and printing
costs.
ALTERNATIVES:
1. Approve the concept of the Transient Merchant' s License, pass the ordinance
on first reading and adopt a resolution setting the fee.
2. Reject the concept.
MANAGER'S RECOMMENDED ACTION:
It is the recommendation of the City Manager that the City Council approve
Alternative #1 which would approve the concept of the Transient Merchant' s
License as outlined above. Included in this approval would be the passage of
the ordinance on first reading and adoption of a resolution establishing the $16
fee.

REMARKS:
The City of Ames has a 1% Local Option Sales
Tax. You must collect 5% Sales Tax on all
products sold in Ames that are not tax exempt.
