COUNCIL ACTION FORM
SUBJECT: Motion Setting Date for Public Hearing to Consider the Adoption of
An Adult Entertainment Ordinance.
BACKGROUND:
Some time ago, the City Council directed that an ordinance amendment be pre-
pared that would regulate the establishment of Adult Entertainment Businesses
in the City.
Initially, the Planning and Zoning Commission studied the policy question of
whether to concentrate or disperse adult entertainment businesses within the
City. It was concluded that a dispersion approach to this type of business
was preferable from a land use standpoint and therefore, the ordinance draft
attached to this Action Form contains the 1,000 foot separation provision. In
addition, the ordinance draft contains a separation provision from other land
uses that are deemed incompatible. These land uses are:
1. Schools
2. Churches
3. Public Parks
4. Public Playgrounds
5. Public Plazas
6. Areas zoned residential
Further, the Planning and Zoning Commission is also recommending that adult
entertainment businesses not be permitted along arterial streets so as to pro-
hibit these businesses from locating at the entrances to the City. To accom-
plish this, the ordinance contains a 200' setback provision from the right-of-
way of an arterial street within the City.
A map is attached to this Council Action Form along with the ordinance draft.
This map generally illustrates where adult entertainment businesses may
locate.
The Planning and Zoning Commission has reviewed this ordinance and has recom-
mended that it be adopted.

ALTERNATIVES:
1. The City Council can approve of the ordinance draft for Adult Entertain-
ment and can set February 3, 1987 as the date of the public hearing to
consider the ordinance.
2. The City Council can deny approval of the ordinance draft.
3. The City Council can refer the ordinance back to the Planning and Zoning
Commission for further review and comment.
MANAGER'S RECOMMENDED ACTION:
It is the recommendation of the City Manager that the City Council adopt Alter-
native #1. This will approve the draft ordinance for Adult Entertainment and
set February 3, 1987 as the public hearing date for this ordinance.
